Madame:

 

     Your Committee on Judiciary & Hawaiian Affairs, to which was referred H.B. No. 1682 entitled:

 

"A BILL FOR AN ACT RELATING TO THE DISCLOSURE OF INTIMATE IMAGES,"

 

begs leave to report as follows:

 

     The purpose of this measure is to enact the Uniform Civil Remedies for Unauthorized Disclosure of Intimate Images Act.

 

     Your Committee received testimony in support of this measure from the Hawaii State Commission on the Status of Women; Uniform Law Commission; American Association of University Women of Hawaiʻi; Hawaiʻi State Coalition Against Domestic Violence; Imua Alliance; and three individuals.  Your Committee received testimony in opposition to this measure from The Sex Abuse Treatment Center.

 

     Your Committee finds that the unauthorized disclosure or threatened disclosure of intimate images constitutes a serious invasion of personal privacy that may result in lasting harm.  Your Committee further finds that existing law lacks a uniform and comprehensive civil framework to address this conduct.  This measure establishes clear civil remedies and procedural safeguards to protect privacy interests while maintaining appropriate limitations and exceptions.

 

     Your Committee has amended this measure by:

 

     (1)  Adding a definition of "sexual conduct";

 

     (2)  Changing its effective date to July 1, 3000, to encourage further discussion; and

 

     (3)  Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.

 

     As affirmed by the record of votes of the members of your Committee on Judiciary & Hawaiian Affairs that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 1682, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 1682, H.D. 1, and be placed on the calendar for Third Reading.
