Madam and Sir:

Your Committee on Conference on the disagreeing vote of the House of Representatives to the amendments proposed by the Senate in H.B. No. 1550, H.D. 2, S.D. 2, entitled:

"A BILL FOR AN ACT RELATING TO HEALTH,"

having met, and after full and free discussion, has agreed to recommend and does recommend to the respective Houses the final passage of this bill in an amended form.

The purpose of this measure is to exempt additional drug testing products from the definition of drug paraphernalia under the Uniform Controlled Substances Act.

Your Committee on Conference has amended this measure by:

(1) Removing items that are used to plant, propagate, cultivate, grow, harvest, test, analyze, pack, repack, store, contain, conceal, inject, ingest, inhale, or otherwise introduce into the human body a controlled substance from the law prohibiting drug paraphernalia under the Uniform Controlled Substances Act;

(2) Restricting the law prohibiting drug paraphernalia under the Uniform Controlled Substances Act to only prohibit items that are used for the manufacturing, compounding, converting, production, processing, or preparing of controlled substances;

(3) Repealing the Department of Health's authority to inspect a qualifying patient's medical records and suspend or revoke the ability of a physician, advance practice registered nurse, or hospice provide to issue a written certification, under certain circumstances;

(4) Inserting a savings clause;

(5) Amending the preamble;

(6) Changing the effective date to upon approval; and

(7) Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.

As affirmed by the record of votes of the managers of your Committee on Conference that is attached to this report, your Committee on Conference is in accord with the intent and purpose of H.B. No. 1550, H.D. 2, S.D. 2, as amended herein, and recommends that it pass Final Reading in the form attached hereto as H.B. No. 1550, H.D. 2, S.D. 2, C.D. 1.
