     Your Committee on Health, to which was referred H.B. No. 1452 entitled:

 

"A BILL FOR AN ACT RELATING TO BIRTH CERTIFICATES,"

 

begs leave to report as follows:

 

     The purpose of this measure is to include advanced practice registered nurses among the types of health care providers who can submit an affidavit for a new certificate of birth for certain birth registrants.  

 

     Your Committee received testimony in support of this measure from Department of Health; Hawaiʻi State Lesbian, Gay, Bisexual, Transgender, Queer Plus Commission; one member of the Hawaiʻi County Council; Stonewall Caucus of the Democratic Party of Hawaiʻi; Kuaʻana Project; Hawaiʻi Health & Harm Reduction Center; Pride at Work Hawaiʻi; HOKU PAC; Lambda Law Student Association of Hawaiʻi; Pilina Center for Wellbeing; and numerous individuals.  Your Committee received comments on this measure from one individual.

 

     Your Committee finds that the limitations on who may provide an affidavit to allow an individual to request the issuance of a new birth certificate that reflects their gender identity create a significant barrier for some of Hawaii's transgender or gender nonconforming residents, particularly those who live in rural communities, have limited financial resources, or whose care is provided by qualified advanced practice registered nurses.  This measure is intended to create more equitable access to accurate identity documents by allowing advanced practice registered nurses to submit an affidavit that will allow for the issuance of a new birth certificates for certain birth registrants.

 

     Your Committee has amended this measure by changing the effective date to July 1, 3000, to encourage further discussion.

 

     As affirmed by the record of votes of the members of your Committee on Health that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 1452, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 1452, H.D. 1, and be referred to your Committee on Consumer Protection & Commerce.
