A BILL FOR AN ACT
RELATING TO PUBLIC SCHOOL LAND TRANSFER.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Act 307, Session Laws of Hawaii 2022, directed the conveyance of the fee simple title to certain lands owned by the department of land and natural resources, county of Kauai, and county of Maui, to the department of education. Since that time, further verification of information and changes in circumstances require the revision of tax map key numbers provided in Act 307, Session Laws of Hawaii 2022.
Accordingly, the purpose of this part is to revise certain tax map key numbers set forth in section 2 of Act 307, Session Laws of Hawaii 2022, for accuracy or changed circumstances.
SECTION 2. Act 307, Session Laws of Hawaii 2022, is amended by amending section 2 to read as follows:
"SECTION 2. (a)
Notwithstanding any other law to the contrary, the fee simple interest
to the parcels of land set forth in this section, together with the existing
improvements thereon, but not including submerged land, accreted land, or any
land makai of the legal shoreline (collectively, the properties), shall be
conveyed by their respective owner or owners to the department of education as
grantee, as is, where is. The department
of education shall accept the properties in their existing condition. All claims and liabilities against the
grantors, if any, that the department of education has, may have had, or may
have in the future, regarding any injury, loss, cost, damage, or liability,
including reasonable [attorney's] attorneys' fees, concerning the
physical, environmental, soil, economic, and legal conditions of the
properties, shall be released, waived, and extinguished.
(b) The
transfer of a property pursuant to this Act shall be effective by operation of
law as of July 1, 2022. The
respective owner or owners of the properties shall prepare, execute, and
record, in the [land court or bureau of conveyances,] office of the
assistant registrar of the land court of the State of Hawaii or the bureau of
conveyances, as appropriate, a quitclaim deed [to convey each of] or
other conveyance instrument to evidence and formally document the conveyance of
each of the properties together with all existing improvements. [Work to initiate the conveyance of the
properties shall commence no later than December 31, 2022. As an alternative to conveyance instruments
for each parcel of state or county owned land, the transfer of such lands shall
be completed by operation of law.] Where
applicable and in the discretion of the department of education, the department
of education may elect to obtain all or a portion of each parcel identified by
this Act. If the department of education
elects to obtain a portion or portions of any parcel identified by this Act,
then the parties to the conveyance shall take all actions necessary to legally
effect the same.
(c)
As these are conveyances in which the county and the State and its
agencies are the only parties, the tax imposed by section 247-1, Hawaii Revised
Statutes, shall not apply.
(d)
Effective [on the date of transfer,] July 1, 2022, every
reference to the titleholder of the properties shall be construed as a
reference to the department of education[.] irrespective of whether a
quitclaim deed or other conveyance instrument has been recorded in the office
of the assistant registrar of the land court of the State of Hawaii or the
bureau of conveyances.

SECTION
3. The department of education shall transfer
fee simple title ownership of the parcel of land identified as the following
tax map key: (4)3-6-002:010 (Wilcox elementary school) to the county of Kauai;
provided that the county of Kauai shall accept the property in its existing
condition. All claims and liabilities
against the department of education, if any, that the county of Kauai has, may
have had, or may have in the future, regarding any injury, loss, cost, damage,
or liability, including reasonable attorneys' fees, concerning the physical,
environmental, soil, economic, and legal conditions of the properties, shall be
released, waived, and extinguished; provided further that as this is a
conveyance in which the county and the State and its agencies are the only
parties, the tax imposed by section 247-1, Hawaii Revised Statutes, shall not
apply.
PART III
SECTION
4. (a)
Notwithstanding any other law to the contrary, the fee simple interest
to the parcels of land set forth in this section, together with the existing
improvements thereon, but not including submerged land, accreted land, or any
land makai of the legal shoreline (collectively, the properties), shall be
conveyed by the department of education to the Hawaii state public library
system as grantee, as is, where is. The
Hawaii state public library system shall accept the properties in their
existing condition. All claims and
liabilities against the grantors, if any, that the Hawaii state public library
system has, may have had, or may have in the future, regarding any injury,
loss, cost, damage, or liability, including reasonable attorneys' fees,
concerning the physical, environmental, soil, economic, and legal conditions of
the properties, shall be released, waived, and extinguished.
(b)
The department of education shall prepare, execute, and record, in the office
of the assistant registrar of the land court of the State of Hawaii or the
bureau of conveyances, as appropriate, a quitclaim deed to convey each of the
properties together with all existing improvements. Work to initiate the conveyance of the
properties shall commence no later than December 31, 2026. As an alternative to conveyance instruments
for each parcel of state or county owned land, the transfer of such lands shall
be completed by operation of law. Where
applicable and in the discretion of the Hawaii state public library system, the
Hawaii state public library may elect to obtain all or a portion of each parcel
identified by this section. If the Hawaii
state public library system elects to obtain a portion or portions of any
parcel identified by this section, then the parties to the conveyance shall
take all actions necessary to legally effect the same.
(c)
As these are conveyances in which the county and the State and its
agencies are the only parties, the tax imposed by section 247-1, Hawaii Revised
Statutes, shall not apply.
(d)
Effective on the date of transfer, every reference to the titleholder of
the properties shall be construed as a reference to the Hawaii state public
library system.
(e)
Parcels to be conveyed by the department of education, identified by tax
map key number, are as follows:
(1) 9-1-001:002 (Ewa Beach public and school library);
(2) 5-6-006:003 (Kahuku public and school library);
(3) 4-1-009:012 (Waimanalo public and school library);
(4) 1-6-002:001 (Keaau public and school library);
(5) 3-5-005:001 (Laupahoehoe public and school library);
(6) 1-8-001:007 (Mountain View public and school library);
(7) 9-6-005:008 (Pahala public and school library);
(8) 1-5-003:038 (Pahoa public and school library);
(9) 6-7-002:024 (Thelma Parker memorial public and school library);
(10) 4-9-014:003 (Lanai public and school library);
(11) 1-3-006:008 (Hana public and school library); and
(12) 2-8-010:011 (Koloa public and school library).
PART IV
SECTION 5. The purpose of this part is to revise the process by which properties were, or may in the future be, conveyed to the department of education pursuant to Act 307, Session Laws of Hawaii 2022.
SECTION 6. Section 302A-1148, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:
"(a) All public school buildings, facilities, and
grounds shall be available for general recreational purposes, and for public
and community use, whenever these activities do not interfere with the normal
and usual activities of the school and its pupils. Any other law to the contrary
notwithstanding, the department shall adopt rules under chapter 91 as are
deemed necessary to carry out the purposes of this section and may issue
licenses, revocable permits, concessions, or rights of entry to school buildings
and grounds for [such] periods of use as deemed appropriate by the
department. [All such dispositions,
including those in excess of fourteen days, need not be approved by the board
of land and natural resources; provided that approval by the board of land and
natural resources shall be required when the dispositions are for periods in
excess of a year.] The department
may assess and collect fees and charges from the users of school buildings,
facilities, grounds, and equipment, which include fees and charges assessed and
collected by the department for parking on roadways and in parking areas under
the jurisdiction of the department, pursuant to section 302A-1151.6. The fees and charges shall be deposited into
a separate fund and expended by the department under rules as may be adopted by
the board; provided that any parking fees assessed and collected by a school
shall be deposited to the credit of that school's nonappropriated local school
fund account."
SECTION 7. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 8. This Act shall take effect upon its approval.
