A BILL FOR AN ACT

 

 

RELATING TO NOISE.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the operation of privately owned and operated refuse collection vehicles in urban areas during early morning hours causes excessive noise and disturbs the sleep of residents.

     Accordingly, the purpose of this Act is to establish a two‑year pilot project to prohibit the operation of privately owned and operated refuse collection vehicles before 6:00 a.m. and after 6:00 p.m. within five hundred feet of any area zoned for mixed-use or residential apartment use within the Waikiki area of the City and County of Honolulu.

     SECTION 2.  (a)  In any urban district, as designated pursuant to section 205-2, Hawaii Revised Statutes, within the Waikiki area of the City and County of Honolulu, it shall be unlawful for any person, before 6:00 a.m. or after 6:00 p.m., to operate a privately owned and operated refuse collection vehicle within five hundred feet of an area zoned for mixed-use or residential apartment use.

     (b)  Nothing in this section shall be construed to preempt or prohibit any county in the State from regulating the use of refuse collection vehicles in a manner that is more stringent than the provisions of this section.  In the event of a conflict between this section and any county rule or ordinance regarding the use of refuse collection vehicles, the more restrictive requirements shall apply.

     (c)  For the purposes of this Act:

     "Mixed-use" shall have the same meaning as defined in section 171‑36.5(f), Hawaii Revised Statutes, but shall also include community development districts.

     "Refuse collection vehicle" means any industrial vehicle having a gross vehicle weight rating greater than       pounds that is used to collect and transport garbage or other refuse.

     "Waikiki area of the City and County of Honolulu " means the boundaries that are delineated in the land use ordinance as amended, establishing the "Waikiki Special District".

     SECTION 3.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 4.  This Act shall take effect on January 30, 2050; provided that this Act shall be repealed on June 30, 2028.
