A BILL FOR AN ACT
RELATING TO HAWAIIAN HOME LANDS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
"§ Tracts
of Hawaiian home lands; multiple leases; prohibition. (a) Notwithstanding any other provision of this
Act or any other law to the contrary, an individual who becomes a
lessee of a tract of Hawaiian home lands, either as an original lessee under section 207 of this Act or as a
successor lessee under section 209 of this Act, shall forfeit any
interest as an original lessee or
successor lessee in any other tract of Hawaiian home lands.
(b) An individual who is a lessee of a tract of
Hawaiian home lands, either as an
original lessee or as a successor lessee, shall be removed from any applicant
waitlist for an original lease of Hawaiian home lands.
(c) The department of Hawaiian home lands shall adopt rules pursuant to chapter 91, Hawaii Revised Statutes, or any successor statute, necessary for the purposes of this section."
SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.
SECTION 3. The provisions of the amendments made by this Act to the Hawaiian Homes Commission Act, 1920, as amended, are declared to be severable, and if any section, sentence, clause, or phrase, or the application thereof to any person or circumstances is held ineffective because there is a requirement of having the consent of the United States to take effect, then that portion only shall take effect upon the granting of consent by the United States and effectiveness of the remainder of these amendments or the application thereof shall not be affected.
SECTION 4. New statutory material is underscored.
SECTION 5. This Act shall take effect upon its approval.
