A BILL FOR AN ACT
RELATING TO CHIROPRACTIC.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
"§442- Chiropractic students; clinical training;
supervision. (a)
Notwithstanding any other law to the contrary, a chiropractic student
may engage in clinical training involving the practice of chiropractic if:
(1) The student is actively enrolled in
a doctor of chiropractic program that is accredited by the Council on
Chiropractic Education, or its successor organization, and approved by the
board;
(2) The clinical training conducted
occurs pursuant to a formal affiliation agreement between the accredited doctor
of chiropractic program and the supervising chiropractor or clinical training
site; and
(3) The student is directly supervised by
the supervising chiropractor; provided that the supervising chiropractor shall:
(A) Be licensed to practice in the
State;
(B) Be physically present at the
location where services are provided; and
(C) Retain full professional and legal
responsibility for the care provided to the patient.
(b) Prior to providing services to a patient, a
chiropractic student providing services pursuant to this section shall inform
the patient that the care will be provided by the student and obtain written
consent from the patient acknowledging that the patient has agreed to receive
services from the chiropractic student.
(c) The board shall adopt rules pursuant to
chapter 91 to implement this section, including:
(1) Qualifications for supervising
chiropractors;
(2) Permissible scope of clinical
services that may be provided by a chiropractic student;
(3) Supervision requirements; and
(4) Documentation and reporting
requirements.
(d) For the purposes of this section, "chiropractic student" means an individually actively enrolled in an accredited doctor of chiropractic program who is participating in clinical training required for completing of the degree."
SECTION 2. The Hawaii board of chiropractic shall submit a report to the legislature no later than twenty days prior to the convening of the regular session of 2027. The report shall include:
(1) Implementation of this Act;
(2) Patient safety;
(3) Student participation; and
(4) Any other recommendations.
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect on December 31, 2050; provided that section 1 shall take effect on July 1, 2028.
