RELATING TO REGISTRATION OF TIME SHARES. Provides that applications for registration renewal required by section 514E-10, Hawaii Revised Statutes, shall be deemed approved upon delivery. Provides that any amendment to a required time share plan registration shall be deemed approved by operation of law on the forty-fifth day after the amendment is submitted to the Director of Commerce and Consumer Affairs, unless the Director issues a deficiency letter within that period. RELATING TO WORKERS' COMPENSATION. Authorizes an attending physician to request a functional capacity examination and refer an injured employee for the examination without first obtaining permission from the employee's employer in order to assess the employee's ability to return to work. Allows licensed occupational and physical therapists to be deemed qualified to perform functional capacity examinations. Effective 7/1/3000. (HD1)

RELATING TO WORKERS' COMPENSATION. Clarifies the process for selecting a certified provider of rehabilitation services. Requires providers to automatically approve vocational rehabilitation services for an injured employee if those services will likely be required for suitable gainful employment. Requires providers to file an employee's vocational plan no later than ninety days after submitting an initial evaluation report, with certain exceptions. Specifies when a rehabilitation plan is considered received by an employer. Effective 7/1/3000. (HD1)

RELATING TO WORKERS' COMPENSATION. Prohibits health care providers from dispensing nonprescription drugs, over-the-counter drugs, and nonlegend drugs for workers' compensation patients. Effective 7/1/3000. (HD1)

RELATING TO CONSUMER PROTECTION. Requires a person or entity marketing or contracting for a residential solar energy device to provide the consumer a one-page standardized disclosure form. Requires any person or entity marketing, selling, or soliciting a residential solar energy device or financing product to comply with consumer protection laws. Prohibits any person or entity from selling a residential solar energy device without holding a contractor's license or having a contractual affiliation with a licensed contractor. Effective 7/1/3000. (HD1)

RELATING TO ELECTRIC VEHICLE INFRASTRUCTURE. Excludes from the definition of "development", as it applies to special management areas, the installation, maintenance, repair, and replacement of an electric vehicle charging system. Includes the Public Utilities Commission in the development and implementation of plans to meet the long-term goals for zero-emissions transportation in the State. Effective 7/1/3000. (HD2)

RELATING TO CONDOMINIUMS. For purposes of registering a condominium project in an agricultural district, (1) lowers the minimum threshold from projects with five units to projects with two units for which a signed statement from a county is required and (2) requires the project applicant to make a presentation on the project to the neighborhood board, if applicable. RELATING TO CHARITABLE SOLICITATION. Beginning 1/1/2027: establishes prompt payment and financial reporting requirements for professional solicitors that sell donated or collected non-perishable tangible property on behalf of charitable organization; and prohibits these professional solicitors from failing to visibly display certain signage; comply with prompt payment, financial reporting, and contract term requirements; or prominently disclose certain information on any collection bin, container, or receptacle used to receive donated property. RELATING TO LIABILITY. Provides certain liability protections for nonprofit child welfare service organizations that are under contract with the Department of Human Services to provide child welfare services to children and families. Prohibits both child welfare service organizations and the State from utilizing indemnification clauses in child welfare service contracts or requiring either party to name the other as an additional insured. Prohibits pre- and post-judgment interest and punitive damages for nonprofit child welfare service organizations. Requires actions against nonprofit child welfare service organizations to be tried by the court, except in certain circumstances. Removes joint and several liability for nonprofit child welfare service organizations. Specifies that no bond shall be required from a nonprofit child welfare service organization on appeal. Effective 7/1/3000. (HD2)

RELATING TO SCHOOL LICENSURE. Transfers the licensing authority of private trade, vocational, and technical schools from the Department of Education to the Department of Commerce and Consumer Affairs. Effective 7/1/3000. (HD1)

RELATING TO SCHOOL PSYCHOLOGISTS. Creates a School Psychologists Working Group within the Department of Education to recommend actionable steps or propose legislation for an immediate pathway to licensure for school psychologists that can be acted upon in 2027. RELATING TO EDUCATION. Requires the Hawaii Teacher Standards Board to develop an alternative pathway for a visiting international educator permit aligned to the duration of the educator's J-1 visa program. Repeals 6/30/2031. Effective 7/1/3000. (HD1)

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony received after this time will be stamped late and left to the discretion of the chair to consider. While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.
Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
The chair may institute a per-testifier time limit.
Committees meeting in the morning must adjourn prior to the day's Floor Session. Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments. However, written submissions will be considered by the committee.
Please refrain from profanity or uncivil behavior. Violations may result in ejection from the hearing without the ability to rejoin.
For remote testifiers, the House will not be responsible for bad connections on the testifier's end.
