Madame:

 

     Your Committee on Judiciary & Hawaiian Affairs, to which was referred S.B. No. 3083, S.D. 2, H.D. 1, entitled:

 

"A BILL FOR AN ACT RELATING TO PROTECTIVE ORDERS,"

 

begs leave to report as follows:

 

     The purpose of this measure is to require notification to the designated security forces of each branch of the United States military when a protective order is issued in a case involving a military-affiliated individual.

 

     Your Committee received testimony in support of this measure from the United States Office of the Assistant Secretary of War; Judiciary; Department of Business, Economic Development, and Tourism; Military and Community Relations Office; and two individuals.

 

     Your Committee finds that the State's large and diverse military population includes servicemembers and families who may become involved in protective order proceedings within the civilian justice system.  When protective orders involving military affiliated individuals are not promptly communicated to appropriate military security forces, opportunities for early intervention, compliance monitoring, and victim protection may be diminished.  Your Committee believes that timely notification and structured coordination will strengthen victim safety, promote accountability, and reduce the risk of repeated violence.

 

     Your Committee has amended this measure by:

 

     (1)  Clarifying the entities that would receive a notification when a protective order is issued in a case involving a military-affiliated individual;

 

     (2)  Deleting the definition of "military"; and

 

     (3)  Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.

 

     As affirmed by the record of votes of the members of your Committee on Judiciary & Hawaiian Affairs that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 3083, S.D. 2, H.D. 1, as amended herein, and recommends that it pass Third Reading in the form attached hereto as S.B. No. 3083, S.D. 2, H.D. 2.
