Sir and Madam:
Your Committee on Conference on the disagreeing vote of the Senate to the amendments proposed by the House of Representatives in S.B. No. 2613, S.D. 1, H.D. 3, entitled:
"A BILL FOR AN ACT RELATING TO PUBLIC SCHOOL LAND TRANSFER,"
having met, and after full and free discussion, has agreed to recommend and does recommend to the respective Houses the final passage of this bill in an amended form.
The purpose of this measure is to:
(1) Revise tax map key numbers and the conveyance process by which identified properties are conveyed to the Department of Education pursuant to Act 307, Session Laws of Hawaii 2022;
(2) Direct the conveyance of certain lands held by the Department of Education to the County of Kauai;
(3) Direct the conveyance of land on which Kaimuki Middle School is located from the City and County of Honolulu to the Department of Education; and
(4) Clarify that land dispositions of school buildings, facilities, and grounds made by the Department of Education shall not require approval from the Board of Land and Natural Resources when these dispositions are for periods exceeding one year.
Your Committee on Conference finds that, since the enactment of Act 307, Session Laws of Hawaii 2022 (Act 307), which directed the conveyance of the fee simple title of certain lands to the Department of Education to consolidate the ownership of land under public schools, newly verified information, parcel consolidation or subdivision, and changed circumstances have affected the tax map key numbers of transferred lands, necessitating amendments to Act 307. This measure makes necessary technical revisions and clarifies the conveyance and disposition processes to reduce jurisdictional complexities and streamline land management projects.
Your Committee on Conference has amended this measure by:
(1) Making it effective upon its approval; and
(2) Making technical, nonsubstantive amendments for the purposes of clarity and consistency.
As affirmed by the record of votes of the managers of your Committee on Conference that is attached to this report, your Committee on Conference is in accord with the intent and purpose of S.B. No. 2613, S.D. 1, H.D. 3, as amended herein, and recommends that it pass Final Reading in the form attached hereto as S.B. No. 2613, S.D. 1, H.D. 3, C.D. 1.
