Madame:
Your Committee on Finance, to which was referred S.B. No. 2575, S.D. 2, H.D. 1, entitled:
"A BILL FOR AN ACT RELATING TO FIREARMS,"
begs leave to report as follows:
The purpose of this measure is to:
(1) Change from a misdemeanor to a class C felony the penalty for possessing, controlling, or transferring ownership of any firearm or ammunition by a person who is restrained by court order from contacting, threatening, or physically abusing any person;
(2) Change from a misdemeanor to a class B felony the penalty for carrying a firearm while under the influence of a controlled substance; and
(3) Establish unlawful possession of methamphetamine while carrying a firearm as a class B felony.
Your Committee received testimony in support of this measure from the Department of Law Enforcement; Mayor of the County of Hawaiʻi; Department of the Prosecuting Attorney of the County of Maui; Honolulu Police Department; Department of the Prosecuting Attorney of the City and County of Honolulu; Office of the Prosecuting Attorney of the County of Hawaiʻi; Hawaiʻi Police Department; Maui Police Department; State of Hawaiʻi Organization of Police Officers; and numerous individuals. Your Committee received testimony in opposition to this measure from the Office of the Public Defender; Libertarian Party of Hawaii; and four individuals. Your Committee received comments on this measure from one individual.
As affirmed by the record of votes of the members of your Committee on Finance that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 2575, S.D. 2, H.D. 1, and recommends that it pass Third Reading.
