Sir and Madam:

Your Committee on Conference on the disagreeing vote of the Senate to the amendments proposed by the House of Representatives in S.B. No. 2268, S.D. 2, H.D. 1, entitled:

"A BILL FOR AN ACT RELATING TO EQUITY,"

having met, and after full and free discussion, has agreed to recommend and does recommend to the respective Houses the final passage of this bill in an amended form.

The purpose of this measure is to:

(1) Require all places of public accommodation and public entity construction projects planned and designed after July 31, 2027, to provide at least one universal changing accommodation within the building in a public restroom, with certain exceptions; and

(2) Make conforming amendments to sections 489-6, 489-7.5, and 489-8, Hawaii Revised Statutes, to prevent conflicts among the provisions.

Your Committee on Conference finds that many individuals with disabilities, individuals who require assistance with personal care, and members of the LGBTQ+ community cannot fully participate in public life due, in part, to the lack of universal changing accommodations in public facilities, a barrier that forces individuals and caregivers to resort to unsafe or undignified alternatives. This measure removes this barrier, thereby ensuring the dignity, safety, and equal access of all people in the State.

Your Committee on Conference has amended this measure by:

(1) Exempting public school facilities from the universal changing accommodation requirements established pursuant to this measure;

(2) Making it effective upon its approval; and

(3) Making technical, nonsubstantive amendments for the purposes of clarity and consistency.

As affirmed by the record of votes of the managers of your Committee on Conference that is attached to this report, your Committee on Conference is in accord with the intent and purpose of S.B. No. 2268, S.D. 2, H.D. 1, as amended herein, and recommends that it pass Final Reading in the form attached hereto as S.B. No. 2268, S.D. 2, H.D. 1, C.D. 1.
