Sir and Madam:
Your Committee on Conference on the disagreeing vote of the Senate to the amendments proposed by the House of Representatives in S.B. No. 2001, S.D. 1, H.D. 2, entitled:
"A BILL FOR AN ACT RELATING TO THE BANYAN DRIVE COMMUNITY DEVELOPMENT DISTRICT,"
having met, and after full and free discussion, has agreed to recommend and does recommend to the respective Houses the final passage of this bill in an amended form.
The purpose of this measure is to:
(1) Establish the Banyan Drive-Makaokū Community Development District and Banyan Drive-Makaokū Redevelopment Agency within the Hawaii Community Development Authority (HCDA);
(2) Establish the Banyan Drive-Makaokū Community Development District Special Fund;
(3) Specify the powers and duties of HCDA as they relate to the new development district;
(4) Amend the composition of HCDA to include representatives of the new development district; and
(5) Appropriate funds.
Your Committee on Conference finds that the Waiakea Peninsula on the island of Hawaii, while historically significant and primely located, currently suffers from inadequate stewardship that has led to the area's decline. This measure would establish a community development district, in the same vein as those of the Kakaako and Pulehunui communities, and a corresponding special fund, to effectively revitalize the Waiakea Peninsula.
Your Committee on Conference has amended this measure by:
(1) Renaming the "Banyan Drive-Makaokū community development district" as the "Banyan Drive community development district" throughout the measure;
(2) Clarifying that the Banyan Drive Community Development District shall also include rights-of-ways;
(3) Deleting language that would have established the Banyan Drive-Makaokū Redevelopment Agency;
(4) Replacing the term "Banyan Drive-Makaokū redevelopment agency" with the term "Banyan Drive Hawaii redevelopment agency" throughout the measure;
(5) Clarifying that the lineal descendant proposed to join the membership of HCDA only for the purposes of the proposed part added to chapter 206E, Hawaii Revised Statutes, by this measure shall be of the Waiakea ahupuaa, rather than of the Makaokū area, throughout the measure;
(6) Inserting an appropriation of $125,000 for the establishment of one full-time equivalent position within the Hawaii Community Development Authority;
(7) Inserting an effective date of July 1, 2026; and
(8) Making technical, nonsubstantive amendments for the purposes of clarity and consistency.
As affirmed by the record of votes of the managers of your Committee on Conference that is attached to this report, your Committee on Conference is in accord with the intent and purpose of S.B. No. 2001, S.D. 1, H.D. 2, as amended herein, and recommends that it pass Final Reading in the form attached hereto as S.B. No. 2001, S.D. 1, H.D. 2, C.D. 1.
