Madam and Sir:
Your Committee on Conference on the disagreeing vote of the House of Representatives to the amendments proposed by the Senate in H.B. No. 649, H.D. 1, S.D. 1, entitled:
"A BILL FOR AN ACT RELATING TO SMALL BOAT HARBORS,"
having met, and after full and free discussion, has agreed to recommend and does recommend to the respective Houses the final passage of this bill in an amended form.
The purpose of this measure is to:
(1) Require a permittee to pay use permit fees that are based on the impact of the permitted activity on natural resources, impact of the activity on public access to and use of state boating facilities and waters of the State, and costs of administering the small boat harbor and coastal areas programs;
(2) Require a use permit application fee to be collected at the time of application;
(3) Require a permittee carrying passengers for hire to pay a monthly fee of a certain amount, with the monthly fee to be paid in lieu of the generally applicable mooring fee if the permittee is using the vessel for commercial purposes from the vessel's permitted mooring;
(4) Clarify that minimum revenue standards for commercial use permit holders are to be set forth in administrative rules; and
(5) Replace language that allows for the automatic thirty‑day extension of an expired commercial use permit with language that allows a permittee who has failed to timely renew a commercial use permit to make a written request to the Department of Land and Natural Resources for a one-time thirty-day permit extension; provided that the request is received by the Department no later than the permit's expiration date.
Your Committee on Conference has amended this measure by:
(1) Changing the effective date to upon approval; and
(2) Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.
As affirmed by the record of votes of the managers of your Committee on Conference that is attached to this report, your Committee on Conference is in accord with the intent and purpose of H.B. No. 649, H.D. 1, S.D. 1, as amended herein, and recommends that it pass Final Reading in the form attached hereto as H.B. No. 649, H.D. 1, S.D. 1, C.D. 1.
