Your Committees on Judiciary and Ways and Means, to which was referred H.B. No. 463, H.D. 3, S.D. 1, entitled:
"A BILL FOR AN ACT RELATING TO EVICTION RECORDS,"
beg leave to report as follows:
The purpose and intent of this measure is to:
(1) Require the Judiciary to conduct a study to determine the ability, best approaches, various issues, and potential impacts of requiring courts to disassociate a residential tenant from an eviction proceeding brought by a landlord in certain circumstances;
(2) Require a report to the Legislature; and
(3) Appropriate funds.
Your Committees received testimony in support of this measure from Hawaiʻi Children's Action Network Speaks!.
Your Committees received comments on this measure from the Judiciary and Hawaiʻi Association of REALTORS.
Your Committees find that eviction records create significant and unjust barriers to securing housing, particularly for parents with children. Families with eviction filings on their records, regardless of the case outcome, often struggle to find stable housing, forcing them into overcrowded conditions, extended stays in shelters, or homelessness. Furthermore, the fear of an eviction record often discourages parents from speaking up about critical habitability issues that pose serious health risks to the occupants. This measure will support the disassociation of eviction records when tenants prevail, empowering families to stand up for their rights without fear of lasting consequences.
Your Committees have amended this measure by:
(1) Updating dates and deadlines to reflect the current legislative session; and
(2) Making technical, nonsubstantive amendments for the purposes of clarity and consistency.
As affirmed by the records of votes of the members of your Committees on Judiciary and Ways and Means that are attached to this report, your Committees are in accord with the intent and purpose of H.B. No. 463, H.D. 3, S.D. 1, as amended herein, and recommend that it pass Third Reading in the form attached hereto as H.B. No. 463, H.D. 3, S.D. 2.
