Madame:
Your Committee on Transportation, to which was referred H.B. No. 2375 entitled:
"A BILL FOR AN ACT RELATING TO TOWING PRACTICES,"
begs leave to report as follows:
The purpose of this measure is to establish uniform standards for parking enforcement and towing practices on state and state‑leased lands, including notice requirements, disability protections, consumer payment safeguards, and public reporting.
Your Committee finds that parking
enforcement and towing practices on state and state-leased lands are currently
fragmented and inconsistently applied, resulting in insufficient consumer
protections, limited transparency, and reduced public accountability. In order to establish uniform standards and
clear lines of authority, it is necessary to examine existing parking and
towing standards and identify inconsistencies among jurisdictions to ensure
fair enforcement, accessibility, and due process for all vehicle owners. Therefore, establishing a working group to
examine these issues will help with creating a unified statewide framework for
parking enforcement and towing on state and state-leased lands, strengthening
consumer protections, improving transparency, and promoting consistent and
accountable practices.
Your Committee has amended this measure by:
(1) Deleting language that would have established uniform standards for parking enforcement and towing practices on state and state‑leased lands;
(2) Inserting language that establishes a Uniform Towing Practices for Public Parking Facilities Working Group within the Department of Transportation, including specifying membership, responsibilities, and reporting requirements; and
(3) Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.
As affirmed by the record of votes of the members of your Committee on Transportation that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 2375, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 2375, H.D. 1, and be referred to your Committee on Water & Land.
