Madame:

 

     Your Committee on Education, to which was referred H.B. No. 2294 entitled:

 

"A BILL FOR AN ACT RELATING TO PUBLIC SCHOOL LAND TRANSFER,"

 

begs leave to report as follows:

 

     The purpose of this measure is to amend Act 307, Session Laws of Hawaii 2022, to revise the tax map key numbers and the process for conveying certain properties to the Department of Education.

 

     Your Committee received testimony in support of this measure from the Department of Education.

 

Your Committee finds that, to consolidate the ownership of all land under existing public schools to be held by the Department of Education, Act 307, Session Laws of Hawaii 2022 (Act 307), was enacted to direct the conveyance of the fee simple title to certain lands owned by the Department of Land and Natural Resources, County of Kauai, and County of Maui to the Department of Education.  Your Committee further finds that, since the enactment of Act 307, further verification of information and changes in circumstances require the revision of certain tax map key numbers.  This measure revises the tax map keys numbers in Act 307 to update the list of properties to be conveyed. 

 

Additionally, this measure also allows more flexibility in the conveyance of these lands and provides that all transfers of the listed properties in Act 307 were effective by operation of law on the date Act 307 was enacted.

 

     Your Committee has amended this measure by:

 

     (1)  Transferring Wilcox Elementary School from the Department of Education to the County of Kauai rather than from the County of Kauai to the Department of Education;

 

     (2)  Changing the effective date to July 1, 3000; and

 

     (3)  Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.

 

     As affirmed by the record of votes of the members of your Committee on Education that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 2294, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 2294, H.D. 1, and be referred to your Committee on Water & Land.
