Madam and Sir:
Your Committee on Conference on the disagreeing vote of the House of Representatives to the amendments proposed by the Senate in H.B. No. 2171, H.D. 1, S.D. 1, entitled:
"A BILL FOR AN ACT RELATING TO THE UNIVERSITY OF HAWAII,"
having met, and after full and free discussion, has agreed to recommend and does recommend to the respective Houses the final passage of this bill in an amended form.
The purpose of this measure is to authorize the University of Hawaii to engage in enterprise-related activities that have an educational nexus on its campuses statewide, notwithstanding county zoning laws or requirements for special use permits.
Your Committee on Conference has amended this measure by:
(1) Clarifying that enterprise-related activities may take place on lands owned, leased, or otherwise controlled by the University;
(2) Specifying that enterprise-related activities authorized under this measure are considered a permitted use on all lands designated for University purposes and further clarifying the exemption of enterprise-related activities from county zoning ordinances and requirements for special use permits, conditional use permits, or other county land use approvals;
(3) Clarifying that the University or its facilities are not exempt from mandatory compliance with technical and safety codes and remain strictly subject to building codes, the State Fire Code, Department of Health sanitation and food safety standards, disability accessibility requirements, and applicable general excise and transient accommodation taxes;
(4) Further clarifying the definition of "enterprise related activities" and what may constitute such activities;
(5) Changing the effective date to upon approval; and
(6) Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.
As affirmed by the record of votes of the managers of your Committee on Conference that is attached to this report, your Committee on Conference is in accord with the intent and purpose of H.B. No. 2171, H.D. 1, S.D. 1, as amended herein, and recommends that it pass Final Reading in the form attached hereto as H.B. No. 2171, H.D. 1, S.D. 1, C.D. 1.
