Madam and Sir:
Your Committee on Conference on the disagreeing vote of the House of Representatives to the amendments proposed by the Senate in H.B. No. 1888, H.D. 3, S.D. 2, entitled:
"A BILL FOR AN ACT RELATING TO THE SAFETY OF EDUCATIONAL WORKERS,"
having met, and after full and free discussion, has agreed to recommend and does recommend to the respective Houses the final passage of this bill in an amended form.
The purpose of this measure is to:
(1) Require the Department of Education and state public charter schools to take certain steps to report incidents of harassment and implement procedures for handling harassment of educational workers, including sports officials;
(2) Authorize the Attorney General to assist educational workers, including sports officials at Department of Education or public charter school sporting events, who have been subject to harassment or intentional bodily injury in obtaining a temporary restraining order;
(3) Clarify that a sports official's duties cover sports events at public schools and private schools; and
(4) Make intentional or knowingly causing bodily injury of an educational worker or a sports official engaged in the lawful discharge of their duties a class C felony for the first offense and a class B felony for a second or subsequent offense within ten years.
Your Committee on Conference has amended this measure by:
(1) Clarifying that the authorization for the Department of the Attorney General to assist educational workers in obtaining a temporary restraining order shall be discretionary;
(2) Deleting language that would have:
(A) Clarified that a sports official's duties cover sports events at public schools and private schools; and
(B) Elevated the intentional or knowingly causing bodily injury of an educational worker or a sports official engaged in the lawful discharge of their duties to a class C felony for the first offense and a class B felony for a second or subsequent offense within ten years;
(3) Inserting language that:
(A) Includes the intentional, knowing or reckless disruption or interference with a school function, school administration, or school board under the offense of harassment; and
(B) Makes harassment to an educational worker, including sports officials, engaged in the performance of their duty a misdemeanor;
(4) Inserting a savings clause;
(5) Changing the effective date to upon approval; and
(6) Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.
As affirmed by the record of votes of the managers of your Committee on Conference that is attached to this report, your Committee on Conference is in accord with the intent and purpose of H.B. No. 1888, H.D. 3, S.D. 2, as amended herein, and recommends that it pass Final Reading in the form attached hereto as H.B. No. 1888, H.D. 3, S.D. 2, C.D. 1.
