Sir:
Your Committee on Commerce and Consumer Protection, to which was referred H.B. No. 1810, H.D. 2, entitled:
"A BILL FOR AN ACT RELATING TO CHARITABLE SOLICITATION,"
begs leave to report as follows:
The purpose and intent of this measure is to:
(1) Establish prompt payment and financial reporting requirements for professional solicitors that sell donated or collected non-perishable tangible property on behalf of charitable organizations; and
(2) Prohibit professional solicitors from failing to:
(A) Visibly display certain signage;
(B) Comply with prompt payment, financial reporting, and contract term requirements; and
(C) Prominently disclose certain information on any collection bin, container, or receptacle used to receive donated or collected property.
Your Committee received testimony in support of this measure from Goodwill Hawaii, Retail Merchants of Hawaii, Hawaiʻi Alliance of Nonprofit Organizations, YWCA Oʻahu, Aloha United Way, National Kidney Foundation of Hawaiʻi, and one individual.
Your Committee finds that some for-profit entities in the State operate collection bins or receptacles and compensate charitable partners based on the weight of the donated items received. These operators can then re-sell the donated property at for-profit retail locations. This arrangement between the collection bin operator and associated charitable organizations can be confusing for donors, as sometimes, only a small fraction of the proceeds is provided to the charity advertised to donors on the bin. This measure would increase transparency, strengthen trust in the nonprofit sector, and support the integrity of charitable giving in the State.
Your Committee has amended this measure by inserting an effective date of July 1, 2050, to encourage further discussion.
As affirmed by the record of votes of the members of your Committee on Commerce and Consumer Protection that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 1810, H.D. 2, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 1810, H.D. 2, S.D. 1, and be referred to your Committee on Judiciary.
