A BILL FOR AN ACT

 

 

Relating to law enforcement.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 139, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§139-    Law enforcement equipment; prohibited.  A law enforcement agency shall be prohibited from acquiring or possessing any military equipment obtained through the federal 1033 and 1122 programs administered by the United States Department of Defense Law Enforcement Support Office including but not limited to:

     (1)  Tracked armored vehicles, or any armored vehicle that uses a tracked system instead of wheels for forward motion;

     (2)  Aircraft, vehicles, or watercraft on which any weapon is mounted;

     (3)  Firearms of .50 caliber or higher;

     (4)  Ammunition of .50 caliber or higher;

     (5)  Grenade launchers, or any firearm or firearm accessory designed to launch small explosive projectiles repeatedly, excluding launchers designed to deploy less-lethal control agents or kinetic projectiles;

     (6)  Bayonets;

     (7)  Camouflage uniforms;

     (8)  Manned fixed wing aircraft;

     (9)  Riot batons, or any non-expandable baton of length greater than twenty-four inches; and

    (10)  Signal blockers, or any device for the purpose of interfering with communication by mobile devices."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
