A BILL FOR AN ACT

 

 

RELATING TO WATER CARRIERS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 271G, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§271G-     Cross-subsidization; prohibition.  (a)  Notwithstanding any law to the contrary, the commission shall not allow, require, approve, establish, or implement any rule, order, decision, or other regulatory action that provides for or results in cross-subsidization involving a water carrier.

     (b)  For purposes of this section, "cross-subsidization" means an internal mechanism utilized by a water carrier where additional revenues earned from profitable routes are used to cover the costs of non-profitable services, routes, or commodity types."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect on July 1, 3000.
