A BILL FOR AN ACT
RELATING TO NOISE.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
Accordingly, the purpose of this Act is to establish a prohibition on the operation of privately owned and operated refuse collection vehicles before 6:00 a.m. and after 6:00 p.m. within five hundred feet of any area zoned for mixed-use or residential apartment use within the Waikiki area of the city and county of Honolulu.
SECTION 2. Chapter 342F, Hawaii Revised Statutes, is amended by adding a new section to part II to be appropriately designated and to read as follows:
"§342F- Refuse collection vehicles; restrictions. (a) In
any urban land use district, as designated pursuant to section 205-2, and within
the Waikiki area of the city and county of Honolulu, it shall be unlawful for any person to
operate a privately owned and operated refuse collection vehicle within five
hundred feet of an area zoned for mixed-use or residential apartment use
before 6:00 a.m. or after 6:00 p.m.
(b) Any county may adopt a rule or
ordinance that places stricter limitations on the use of refuse collection
vehicles in a manner that is more stringent than the provisions of this
section. In the case of a conflict
between the requirements or limitations of this section and any county rule or
ordinance regarding the use of refuse collection vehicles, the more restrictive
requirements shall apply.
(c) For the purposes of this
section:
"Mixed-use" means a development that combines two or more of
the following uses in a single project:
commercial use, resort use, multifamily residential use, or government
use. "Mixed-used" includes
community development districts.
"Refuse collection vehicle" means any industrial vehicle having
a gross vehicle weight rating greater than 20,000 pounds that is used to
collect and transport garbage or other refuse.
"Waikiki area of the city and county of Honolulu" means the boundaries that are
delineated in the land use ordinance, as amended, establishing the
"Waikiki Special District"."
SECTION 3. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.
SECTION 4. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 5. This Act shall take effect on January 30, 2050; provided that this Act shall be repealed on June 30, 2028.
