A BILL FOR AN ACT

 

 

RELATING TO NOISE.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the operation of privately owned and operated refuse collection vehicles in urban areas during early morning hours causes excessive noise and disturbs the sleep of residents.

     Accordingly, the purpose of this Act is to prohibit the operation of privately owned and operated refuse collection vehicles before 6:00 a.m. and after 6:00 p.m. within five hundred feet of any area zoned for mixed-use or residential apartment use within any county having a population of five hundred thousand or more.

     SECTION 2.  Chapter 324F, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§342F-     Refuse collection vehicles; restrictions.  (a)  In any urban district in the State, as designated pursuant to section 205-2, in any county having a population of five hundred thousand or more, it shall be unlawful for any person, before 6:00 a.m. or after 6:00 p.m., to operate a privately owned and operated refuse collection vehicle within five hundred feet of an area zoned for mixed-use or residential apartment use.

     (b)  Nothing in this section shall be construed to preempt or prohibit any county in the State from regulating the use of refuse collection vehicles in a manner that is more stringent than the provisions of this section.  In the event of a conflict between this section and any county rule or ordinance regarding the use of refuse collection vehicles, the more restrictive requirements shall apply.

     (c)  For the purposes of this section:

     "Mixed-use" shall have the same meaning as in section 171‑36.5(f), but shall also include community development districts.

     "Refuse collection vehicle" means any industrial vehicle having a gross vehicle weight rating greater than      pounds that is used to collect and transport garbage or other refuse."

     SECTION 3.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect on July 1, 2026.
