A BILL FOR AN ACT

 

 

Relating to Parking for Persons with Disabilities.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the statewide parking program for persons with disabilities, administered by the department of health's disability and communication access board, helps individuals with impaired mobility travel by providing access to accessible parking spaces.  Disability parking is also governed by federal law, including The Uniform System for Parking for Persons with Disabilities, which requires all states to allow out-of-state visitors to bring and use in reserve accessible parking spaces the disability parking permit issued by the visitor's home state.  Thus, all fifty states recognize reciprocity for parking permits issued in other jurisdictions.

     The legislature further finds that when traveling to other states, Hawaii residents using removable windshield placards frequently encounter the need to use the placard to park in an accessible parking space at a state airport or port, while also needing to take their parking placard with them for use during their travels.  The legislature recognizes that residents should not have to make a choice between these options.

     Accordingly, the purpose of this Act is to authorize the issuance of temporary disability parking travel placards to residents possessing a removable windshield placard, to be valid for the limited duration of travel.

     SECTION 2.  Chapter 291, Hawaii Revised Statutes, is amended by adding a new section to part III to be appropriately designated and to read as follows:

     "§291-     Issuance of disability parking travel placard.  (a)  The issuing agency shall issue one temporary disability parking travel placard to an applicant who:

     (1)  Possesses a valid removable windshield placard; and

     (2)  Submits:

          (A)  A completed application form provided by the issuing agency; and

          (B)  A copy of the applicant's proof of travel, according to standards determined by the issuing agency.

The placard shall expire on the last day of the month following the return date indicated on the proof of travel.

     (b)  As used in this section, "disability parking travel placard" means a temporary, two-sided, hanger-style placard issued pursuant to subsection (a)."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
