A BILL FOR AN ACT

 

 

RELATING TO CRIME.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 706, Hawaii Revised Statutes, is amended by adding a new section to part III to be appropriately designated and to read as follows:

     "§706-     Fines doubled; certain offenders.  Notwithstanding any law to the contrary, any person convicted of an offense under chapter 707 or 708 who is subsequently convicted of an offense under the same chapter shall, upon the second or subsequent conviction, be required to pay a fine that is twice the maximum fine that would otherwise be imposed for the subsequent conviction."

     SECTION 2.  Chapter 706, Hawaii Revised Statutes, is amended by adding a new section to part IV to be appropriately designated and to read as follows:

     "§706-     Terms of imprisonment doubled; certain offenders.  Notwithstanding any law to the contrary, any person convicted of an offense under chapter 707 or 708 who is subsequently convicted of an offense under the same chapter shall, upon the second or subsequent conviction, be required to serve a term of imprisonment that is twice the maximum term of imprisonment that would otherwise be imposed for the subsequent conviction."

     SECTION 3.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect upon its approval.
