A BILL FOR AN ACT

 

 

relating to transportation.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 291C, Hawaii Revised Statutes, is amended by adding a new section to part XIII to be appropriately designated and to read as follows:

     "§291C-     Electric bicycles; sales; operation; prohibited.  (a)  No person shall:

     (1)  Sell, offer for sale, lease, rent, or otherwise distribute, or possess a high-speed electric bicycle; or

     (2)  Operate a high-speed electric bicycle upon any bicycle lane, highway, roadway, or street.

     (b)  Any person who violates this section shall be subject to a fine of no less than $           and no more than $           for each violation.  Each sale, offer for sale, lease, rental, distribution, possession, or operation of a high-speed electric bicycle shall constitute a separate offense.

     (c)  For purposes of this section, "high-speed electric bicycle" means a bicycle that is:

     (1)  Equipped with fully operable pedals and an electric motor that provides assistance only when the rider is pedaling; and

     (2)  Capable of reaching speeds greater than twenty miles per hour with motor assistance."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
