      Status & Testimony

RELATING TO DIRECT NEGOTIATION FOR PUBLIC LAND LEASES.

Authorizes disposition of public land leases for agricultural, commercial, industrial, hotel, and resort purposes through direct negotiation.

      Status & Testimony

RELATING TO REVOCABLE PERMITS.

Requires the Department of Land and Natural Resources to obtain approval from the Board of Land and Natural Resources before taking any action on a revocable permit.  Requires a six-month notice for any actions taken that result in current tenant eviction.  Prohibits tenant eviction in the year of renewal or during the renewed year.

RELATING TO THE BOARD OF LAND AND NATURAL RESOURCES.

Limits the discretion of the Land Division of the Department of Land and Natural Resources by requiring the Board of Land and Natural Resources to approve all revoked, limited, condemned, removed, or modified public land leases or revocable permits.

SB 2153

      Status & Testimony

RELATING TO PUBLIC LANDS.

Repeals the requirement for Board of Land and Natural Resources approval for lease extensions in the Hilo Community Economic District.  Requires the Department of Land and Natural Resources to use the current tax assessed value when offering lease extensions to lessees.  Requires all applications to the Department of Land and Natural Resources for an extension of fixed rental periods or lease terms to be made within 180 days and confirm lease extensions.

SB 2035

      Status & Testimony

RELATING TO THE LAND USE COMMISSION.

Specifies that a simple majority of affirmative votes of the members of the Land Use Commission present at a meeting and qualified to vote is required for any boundary amendment.  Reduces the number of days by when the Land Use Commission must act for certain actions related to amendments to district boundaries.

SB 2175

      Status & Testimony

RELATING TO HOUSING.

Authorizes the counties to reclassify up to one hundred acres of land areas in certain rural, urban, and agricultural districts; provided that at least seventy-five per cent of the housing units on the land sought to be reclassified are set aside for persons and families with incomes at or below one hundred per cent of the area median income.

RELATING TO THE LAND USE COMMISSION.

Authorizes a county to initiate a land use boundary amendment to implement the county's general plan.

RELATING TO HISTORIC PRESERVATION.

Expands the definition of "historic property" for purposes of the historic preservation program.  Exempts state projects on state-owned buildings from state historic preservation division review unless the affected property is more than one hundred years old or on or being added to the Hawaii register of historic places or the national register of historic places.

RELATING TO HISTORIC PROPERTY.

Amends the definition of "historic property" to include buildings and structures that predate 8/21/1959.

RELATING TO HISTORIC PRESERVATION.

Extends the sunset date for the historic preservation tax credit to December 31, 2030, and incrementally increases the cap on the total tax credits from $1,000,000 in the 2025 taxable year to $4,000,000 in the 2030 taxable year.

      Status & Testimony

RELATING TO REGULATION OF ARCHAEOLOGICAL ACTIVITIES.

Clarifies that failure to comply with approved mitigation commitments, conduct an archaeological inventory survey, or comply with other administrative requirements pertaining to archaeology approved by the Department of Land and Natural Resources shall result in civil and administrative violations.

RELATING TO TORT LIABILITY.

Clarifies that persons or minors that enter private property with or without charge by a landowner for recreational purposes have no cause of action, unless exempted under law.  Requires a court to award attorneys' fees and costs to landowners if plaintiffs bring unreasonable claims.  Establishes as a matter of law, persons or minors participating in outdoor recreational activities accept the inherent dangers in the activities.
