Status

RELATING TO THE HURRICANE RESERVE TRUST FUND.

Moves the Hurricane Reserve Trust Fund into the State Treasury and makes other housekeeping amendments relating to the Fund.

Status

RELATING TO THE DEPARTMENT OF LAND AND NATURAL RESOURCES.

Prohibits the operation of a rental watercraft in state parks on a Saturday, Sunday, or state holiday.  Beginning 1/1/2025, requires rental watercrafts to be registered with the Department of Land and Natural Resources.

Status

RELATING TO OCEAN RECREATION EQUIPMENT.

Authorizes the Board of Land and Natural Resources to issue interim administrative rules to quickly regulate the use of ocean recreation equipment, especially new and emerging ocean recreation technologies, in state ocean waters until long-term administrative rules can be implemented.

RELATING TO OCEAN RECREATION COMMERCIAL PERMITS.

Requires that any newly established ocean recreation management area include the same or greater number of commercial use permits as the number of permits applicable to the area before the establishment of the ocean recreation management area.

Status

RELATING TO COMMERCIAL OCEAN RECREATION OPERATIONS.

Specifies that the Department of Land and Natural Resources can issue new ocean recreation commercial use permits by unsealed public auction.  Revises provisions relating to boating and ocean recreation fees and permits.  Specifies how commercial use permits may be issued where a permit limit has been exceeded.

Status

RELATING TO OCEAN RECREATION MANAGEMENT.

Designates all ocean waters of the State within 3,000 feet from shore as ocean recreation management areas (ORMAs).  Prohibits commercial activity in ORMAs unless authorized by use permit.  Prohibits commercial activities in ORMAs on weekends and state and federal holidays unless authorized by the Board of Land and Natural Resources.

RELATING TO COMMERCIAL OCEAN ACTIVITY.

Includes advertisements and offers in the definition of "commercial activity" as used in chapter 200, HRS.  Provides that advertisements or offers for commercial activity are prima facie evidence that the owner disseminated or directed dissemination of such advertisements or offers.

Status

RELATING TO STATE BOATING FACILITIES.

Establishes a state boating facility lease pilot program within the Department of Land and Natural Resources to lease one state small boat harbor for private development, management, maintenance, and operation in a county with a population of less than 900,000.  Repeals provisions related to the leasing of fast lands and submerged lands of the Ala Wai boat harbor.  Repeals on 6/30/2044.

Status

RELATING TO FISHPONDS.

Appropriates funds to the Board of Land and Natural Resources to create a standard lease application and programmatic environmental impact statement to streamline the process of leasing government-owned Hawaiian fishponds, prioritizing community co-managed organizations and projects.

Status

RELATING TO RENT CREDITS FOR DEMOLITION AND INFRASTRUCTURE COSTS ON PUBLIC LAND LEASES.

Repeals the sunset provision of Act 222, SLH 2021, to allow the Board of Land and Natural Resources to approve rent credits for demolition and infrastructure costs for public land leases beyond the currently scheduled sunset date of June 30, 2026.

RELATING TO DIRECT NEGOTIATION FOR PUBLIC LAND LEASES.

Authorizes disposition of public land leases for agricultural, commercial, industrial, hotel, and resort purposes through direct negotiation.

Status

RELATING TO UPDATING PUBLIC LAND LEASES ISSUED PURSUANT TO CHAPTER 171, HAWAII REVISED STATUTES.

Requires that lease extensions approved by the Board of Land and Natural Resources (Board) be drafted on forms that reflect contemporary leasing practices and policies of the Board, and which shall control over conflicting or inconsistent provisions in the lease being extended.

Status

RELATING TO THE HILO COMMUNITY ECONOMIC DISTRICT.

Clarifies that the Board of Land and Natural Resources shall not unilaterally amend the terms and conditions of any lease of public lands being extended pursuant to Act 149, Session Laws of Hawaii 2018, except as otherwise provided therein; and if the Board of Land and Natural Resources wishes to amend the terms and conditions of any lease of public lands being extended to reflect the Board's most current lease form and leasing practices and policies, such lease form and leasing practices and policies must be included in the rules of the Board.  Defines "lease of public lands".  Repeals 6/30/2028.

RELATING TO INSPECTIONS ON PUBLIC LAND.

Establishes a statutory framework for inspections of public land leases, licenses, and revocable permits by the Department of Land and Natural Resources.

RELATING TO THE SPECIAL LAND AND DEVELOPMENT FUND.

Authorizes the use of special land and development fund moneys to eradicate or mitigate invasive species and install and maintain safety improvements on improved lands that provide lease revenue to the Department of Land and Natural Resources and that have significant cultural or historic value.  Appropriates moneys out of the special land and development fund.

The chair may institute a per-testifier time limit.

 

Committees meeting in the morning must adjourn prior to the day's Floor Session.  Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments.  However, written submissions will be considered by the committee.
