RELATING TO HIGHWAY SAFETY.

Establishes the Automated Speed Enforcement Systems Program.  Authorizes the state or counties to administer the Automated Speed Enforcement Systems Program.  Requires fines collected beginning 1/1/2025 for violations on a county highway to be expended for the operation of the Automated Speed Enforcement Systems Program.  Creates a new offense of noncompliance with the posted speed limit under the Automated Speed Enforcement System.  Appropriates funds.

Amends sections 286-234 and 286-249, HRS, to adopt federal penalties for commercial driver's license violations.

RELATING TO COMMERCIAL DRIVER'S LICENSES.

Revises sections 286-239 and 286-240, HRS, to meet new federal regulations for commercial driver's licenses when the Drug and Alcohol Clearinghouse prohibits a driver from operating a commercial vehicle due to alcohol and drug violations.

Status

RELATING TO COMMERCIAL DRIVER'S LICENSES.

Creates two new commercial driver's license (CDL) restrictions. The "R" restriction is for drivers who pass the skills test on Lanai or Molokai and are limited to operate commercial motor vehicles (CMV) on those islands only.  The "Q" restriction is for CDL holders who pass the skills test with a CMV that is 18,000 pounds or less gross vehicle weight rating (GVWR).

RELATING TO IDENTIFICATION CARDS.

Authorizes and establishes a regulatory framework for the issuance, use, and acceptance of electronic credentials.

RELATING TO DRIVER'S LICENSES.

Requires the examiner of drivers of a county to conduct the testing of an applicant for a driver's license to demonstrate the ability to exercise ordinary and reasonable control in the operation of a motor vehicle in English or in certain other languages at the request of the applicant.

Status

RELATING TO DRIVING WITHOUT A LICENSE.

Adds confiscation of a vehicle as a maximum penalty on a third conviction for operating a motor vehicle without a license within a five-year period.  Provides that if the defendant is not the registered owner of the vehicle used to commit the third offense, the owner of the vehicle shall be responsible for certain costs and fines.

RELATING TO THE DEPARTMENT OF TRANSPORTATION.

Authorizes the Department of Transportation to allow helicopter operations during daylight hours at Kapalua airport.

Status

RELATING TO PARKING FOR DISABLED PERSONS.

Authorizes the Examiner of Drivers to suspend the driver's license of a person using a parking permit issued to a deceased person who was deceased when the permit was issued to obtain parking privileges; provides that fifty per cent of any fine imposed for violating part III of chapter 291, HRS,  is remitted to the law enforemcent agency that issued the citation.  Authorizes each county to enact ordinances to enforce the design and construction requirements for the provision of accessible parking spaces, including the establishment of penalties for failure to comply with the ordinances.  Authorizes officials appointed by a county to enter the property of places of public accommodation to enforce violations of the county ordinances.

RELATING TO TRANSPORTATION.

Requires the Department of Transportation to select multiple certified vendors to install ignition interlock devices.

RELATING TO DRIVING WHILE INTOXICATED.

Establishes an intoxicated driving reduction working group to make recommendations for amendments to existing laws to reduce incidents of intoxicated driving.

RELATING TO SOBRIETY CHECKS.

Establishes a sobriety checkpoints special fund to provide funding to county law enforcement agencies for staffing for sobriety checks.  Increases the state vehicle registration fee to be deposited into the sobriety checkpoints special fund.  Appropriates funds into the sobriety checkpoints special fund and out of the special fund as grants-in-aid for the counties.

Status

RELATING TO INTOXICATING LIQUOR.

Prohibits any person convicted of operating a vehicle under the influence of an intoxicant or habitually operating a vehicle under the influence of an intoxicant from purchasing or publicly consuming alcohol for a certain period.

RELATING TO THE USE OF INTOXICANTS WHILE OPERATING A VEHICLE.

Lowers the threshold blood alcohol concentration for the offenses of operating a vehicle under the influence of an intoxicant and habitually operating a vehicle under the influence of an intoxicant.

DECISION MAKING TO FOLLOW

 

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  Testimony received after this time will be stamped late and left to the discretion of the chair to consider.  While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.

 

Testimony submitted will be placed on the legislative website.  This public posting of testimony on the website should be considered when including personal information in your testimony.

 

The chair may institute a per-testifier time limit.

 

Committees meeting in the morning must adjourn prior to the day's Floor Session.  Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments.  However, written submissions will be considered by the committee.

 

Please refrain from profanity or uncivil behavior.  Violations may result in ejection from the hearing without the ability to rejoin.

 

For remote testifiers, the House will not be responsible for bad connections on the testifier's end.
