Status

RELATING TO FLOODING.

Appropriates moneys to each county to mitigate flood risks on privately owned roads.  Provides that the appropriation or expenditure of moneys shall not be construed to establish a duty of care or grounds for liability for the State or counties.  Declares that the appropriations exceed the state general fund expenditure ceiling for 2024-2025.

Status

RELATING TO THE DEPARTMENT OF TRANSPORTATION.

Authorizes the Department of Transportation to acquire any real, personal, or mixed property for immediate or future use; own, hold, improve, rehabilitate, sell, assign, exchange, transfer, convey, lease, or dispose of any real, personal, or mixed property acquired; and acquire by condemnation real property for immediate or future use.  Amends the definition of "public lands" to exclude lands to which the Department of Transportation holds title.  Authorizes the Department of Transportation to directly acquire any real property for its purposes.

Status

RELATING TO TRAFFIC VIOLATIONS.

Specifies that a portion of the revenues collected from traffic violations shall be disbursed to the county that enforced the violation.

Status

RELATING TO THE INTERISLAND TRANSPORT OF HYDROGEN.

Authorizes the Public Utilities Commission to establish a discounted rate by tariff for water carriers that engage in the interisland transport of hydrogen.

Status

RELATING TO HIGHWAY SAFETY.

Establishes the Automated Speed Enforcement Systems Program.  Authorizes the state or counties to administer the Automated Speed Enforcement Systems Program.  Requires fines collected beginning 1/1/2025 for violations on a county highway to be expended for the operation of the Automated Speed Enforcement Systems Program.  Creates a new offense of noncompliance with the posted speed limit under the Automated Speed Enforcement System.  Appropriates funds.

HB 2071

Status

RELATING TO PHOTO RED LIGHT IMAGING DETECTOR SYSTEMS.

Provides that any photo red light imaging detector system's clear and unobstructed recorded image of a motor vehicle license plate shall be prima facie evidence that the motor vehicle to which the license plate is attached is the motor vehicle for which the license plate was issued.  Requires the State, the county, or the State's or county's third party contractor to implement a process to record the date on which the summons or citation was submitted to the post office, which shall be prima facie evidence of the date the summons or citation was submitted to the post office.

Allows for a percentage of general excise and fuel taxes generated by the counties to be used for maintenance of private roadways that are open to the public.

RELATING TO MOTOR VEHICLE TOWING FEES.

Authorizes tow operators to charge additional reasonable amounts for overturned vehicles.

Proposed HD1

Status

RELATING TO TRANSPORTATION.

Proposed HD1:  Permits a shipping container chassis that holds a valid out-of-state certificate of vehicle registration to obtain a certificate of safety inspection. Makes an out-of-state registration for a shipping container chassis valid in the State until its expiration in the other state or for one year after a vehicle safety inspection.

Note:  This proposed draft differs from the version as received by the committee, and contains amendments that, while significant, do not change the bill's intended purpose.  The proposed draft is being provided so the public may testify on its contents.

DECISION MAKING TO FOLLOW

 

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  Testimony received after this time will be stamped late and left to the discretion of the chair to consider.  While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.

 

Testimony submitted will be placed on the legislative website.  This public posting of testimony on the website should be considered when including personal information in your testimony.

 

The chair may institute a per-testifier time limit.

 

Committees meeting in the morning must adjourn prior to the day's Floor Session.  Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments.  However, written submissions will be considered by the committee.

 

Please refrain from profanity or uncivil behavior.  Violations may result in ejection from the hearing without the ability to rejoin.

 

For remote testifiers, the House will not be responsible for bad connections on the testifier's end.
