RELATING TO CRIMINAL JUSTICE REFORM.

Requires law enforcement officers to issue citations in lieu of arrest for certain offenses.

RELATING TO CRIMINAL JUSTICE REFORM.

Allows the court to order substance abuse assessment and treatment.  Prohibits the arrest of a parolee, or the revocation of parole, solely due to the defendant having 1 positive test for drug use.

RELATING TO WEAPONS.

Prohibits carrying or using a firearm in the commission of a separate misdemeanor offense.  Amends and clarifies prohibitions regarding deadly or dangerous weapons, regarding switchblade knives, and regarding butterfly knives.

RELATING TO INDECENT EXPOSURE.

Raises the criminal penalty for the offense of indecent exposure from a petty misdemeanor to a misdemeanor if the victim is less than sixteen years of age.  Provides that the state of mind requirement is not applicable to the fact that the victim is less than sixteen years of age and that the actor is strictly liable with respect to the attendant circumstance that the victim was less than sixteen years of age.

RELATING TO THE DEPARTMENT OF LAW ENFORCEMENT.

Clarifies that the Director of Law Enforcement has authority to issue subpoenas as part of the investigative powers of the department.

Establishes the felony offenses of misuse of unmanned aircraft in the 1st, 2nd, and 3rd degrees.

RELATING TO CRIMES AGAINST ELDERS.

Establishes strict liability for crimes against elders with respect to the attendant circumstance that the victim was 60 years of age or older.

RELATING TO EMERGENCY MANAGEMENT.

Removes the ability for a Mayor or the Governor to suspend electronic media transmission during a state of emergency.

RELATING TO CAMPAIGN FINANCE.

Prohibits contributions from persons convicted of various campaign finance, lobbying, or ethical offenses.  Redirects unlawful contributions to the campaign spending commission.

Requires certain solicitations that reference disasters to include a disclosure.  Deems violators guilty of a class C felony.

RELATING TO CONTESTED CASES.

Clarifies that a contested case hearing is not required when a tribunal has already issued a final decision and order in a substantially similar contested case proceeding that was not appealed, or where a court of last resort has already issued a final decision on the proceeding or on other substantially similar matters.

Status

RELATING TO CORRECTIONS.

Restricts the use of solitary confinement in state-operated and state-contracted correctional facilities, with certain specified exceptions.  Prohibits the use of solitary confinement and requires the use of appropriate alternatives for committed persons who are members of a vulnerable population.  Requires the Department of Corrections and Rehabilitation to develop written policies and procedures regarding solitary confinement by 7/1/2025.  Requires the Department to develop policies and procedures to review committed persons placed in solitary confinement and develop a plan for committed persons currently in solitary confinement by 4/1/2025.  Requires a report to the Legislature and Hawaii Correctional System Oversight Commission.  Effective 7/1/3000.  (HD1)

Status

RELATING TO DRIVING WITHOUT A LICENSE.

Adds forfeiture of a vehicle as a maximum penalty on a third conviction for operating a motor vehicle without a license within a five-year period.  Effective 7/1/3000.  (HD1)

Status

RELATING TO MOTOR VEHICLES.

Increases penalties for certain offenses relating to the unauthorized driving or operation of motor vehicles.  Effective 7/1/3000.  (HD1)

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  Testimony received after this time will be stamped late and left to the discretion of the chair to consider.  While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.

 

Testimony submitted will be placed on the legislative website.  This public posting of testimony on the website should be considered when including personal information in your testimony.

 

The chair may institute a per-testifier time limit.

 

Committees meeting in the morning must adjourn prior to the day's Floor Session.  Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments.  However, written submissions will be considered by the committee.

 

Please refrain from profanity or uncivil behavior.  Violations may result in ejection from the hearing without the ability to rejoin.

 

For remote testifiers, the House will not be responsible for bad connections on the testifier's end.
