RELATING TO HISTORIC PRESERVATION.

Amends the definition of "historic property" for purposes of the historic preservation program.  Exempts state projects on state-owned buildings from state historic preservation division review unless the affected property is more than one hundred years old or on or being added to the Hawaii register of historic places or national register of historic places.  Requires the department of accounting and general services to conduct a comprehensive survey and inventory of all state-owned buildings within five years to evaluate and nominate potentially eligible buildings for listing on the Hawaii register of historic places or national register of historic places.  Appropriates funds.  Effective 7/1/3000.  (HD1)

RELATING TO BURIAL COUNCILS.

Allows any burial council member whose term has expired to continue in office as a holdover member until the member's reappointment to a second term is confirmed or a successor is nominated and appointed; provided that a holdover member shall not hold office beyond the end of the fourth regular session of the legislature following the expiration of the member's term of office.  Effective 7/1/3000.  (HD1)

RELATING TO OPIOID LITIGATION PROCEEDS.

Establishes the Hawaii opioid litigation proceeds special fund.  Establishes the Hawaii opioid litigation proceeds council to administer the special fund.  Establishes standards for expenditure of opioid litigation proceeds received by the State.  Establishes and appropriates funds from the Hawaii opioid litigation proceeds special fund for three full-time equivalent positions.  Effective 7/1/3000.  (HD1)

Amends the offense of manslaughter to include cases where a person knowingly and unlawfully distributes a dangerous drug in any amount and thereby recklessly causes the death of another person who ingested that drug.

Clarifies membership and certain powers and duties of the Law Enforcement Standards Board and establishes new deadlines for the completion of board responsibilities.

RELATING TO CRIMINAL JUSTICE DATA SHARING GROUPS.

Amends the Criminal Justice Data Sharing Working Group to combine its members and functions with certain members and functions of the Gun Violence and Violent Crimes Commission to increase efficiency and effectiveness and eliminate redundancy.  Repeals chapter 134C, Hawaii Revised Statutes, which established the Gun Violence and Violent Crimes Commission.

RELATING TO COMMERCIAL DRIVER'S LICENSES.

Amends existing state law to adopt federal penalties for commercial driver's license violations.  Effective 7/1/3000.  (HD1)

RELATING TO ELECTRIC VEHICLE PARKING.

Removes the exemption that allowed owners of multiple parking facilities within the State to designate and electrify fewer parking spaces than required in one or more of the properties if the requirement for the total number of aggregate spaces on all of their owned properties was met.  Authorizes the counties to adopt ordinances to regulate electric vehicle charging systems for places of public accommodation with fewer than one hundred parking spaces.  Effective 7/1/3000.  (HD1)

RELATING TO LAW ENFORCEMENT OFFICERS.

Requires law enforcement agencies and the Law Enforcement Standards Board to consult the National Decertification Index and ensure reporting of officer misconduct to the Index.  Requires reporting of certain domestic violence records to the National Decertification Index, notwithstanding any contrary law or court order.  Effective 7/1/3000.  (HD1)

RELATING TO GENERAL EMPLOYEE ORIENTATION.

Allows an employee or the exclusive representative, if applicable, to file a complaint with the Hawaii Labor Relations Board if the employer fails to comply with section 78-64, Hawaii Revised Statutes, relating to general employee orientation.  Effective 7/1/3000.  (HD1)

RELATING TO ENFORCEMENT OF ORDERS OF WAGE PAYMENT.

Broadens enforcement of orders of wage payment violations to allow for certified copies of orders of wage payment violation to be filed in any court of competent jurisdiction.  Effective 7/1/3000.  (HD1)

Includes the prevention of activities within an applicant's premises and adjacent areas that are potentially injurious to the health, safety, and welfare of the public and neighborhood as a factor for determining whether a controlled substances registration is in the public interest.

RELATING TO EDUCATION.

Establishes a harm to students registry for all preschools and K-12 educational institutions within the State that contains information on school employees, contractors, or volunteers for whom, as result of an investigation, a final finding has been issued that the individual has inflicted harm on a student.  Defines "inflicted harm on a student".  Allows for an appeal process to remove an individual's name from the registry.  Appropriates funds.  Effective 7/1/3000.  (HD1)

RELATING TO THE SAFETY OF EDUCATIONAL WORKERS.

Requires the Department of Education and public charter schools to take certain steps to report incidents of harassment and implement procedures for handling harassment of educational workers.  Creates the offense of harassment of an educational worker.  Effective 7/1/3000.  (HD1)

The chair may institute a per-testifier time limit.

 

Committees meeting in the morning must adjourn prior to the day's Floor Session.  Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments.  However, written submissions will be considered by the committee.

 

Please refrain from profanity or uncivil behavior.  Violations may result in ejection from the hearing without the ability to rejoin.
