RELATING TO HISTORIC PRESERVATION. Extends the sunset date for the historic preservation tax credit to December 31, 2030, and adjusts the cap on the total tax credits for future taxable years. Effective 7/1/3000. (HD1)

RELATING TO EMERGENCY MANAGEMENT. Clarifies that the Governor's and mayors' emergency management powers shall be consistent with the state constitution. Clarifies the scope of the comprehensive emergency management plan. Clarifies the powers of the Governor and mayors to extend or terminate a state of emergency. Shortens the duration of price control periods from ninety-six hours to seventy-two hours. Effective 7/1/3000. (HD1)

RELATING TO ADMINISTRATIVE FEES. Statutorily establishes a Department of Land and Natural Resources transaction fee for each recording in the Bureau of Conveyances and Land Court. Authorizes the Board of Land and Natural Resources to adopt, amend, or repeal administrative fees, including transaction fees, for recordings in the Bureau of Conveyances and Land Court separate from the administrative rulemaking process. Amends the authorized uses of moneys in the bureau of conveyances special fund. Repeals language that required the Bureau of Conveyances' microfilm fees to be established by rules. Effective 1/1/3000. (HD1)

RELATING TO CONSERVATION MITIGATION PROGRAMS. Authorizes the Department of Land and Natural Resources to operate and approve conservation bank and conservation in-lieu fee mitigation programs. Effective 7/1/3000. (HD1)

RELATING TO SEARCH AND RESCUE. Repeals the existing conditions under which government entities may seek reimbursement for search or rescue expenses and instead requires a government entity of the State to impose and collect a fee for search or rescue expenses for persons who require rescue after leaving a hiking trail to enter an area closed to the public or hiking on a trail closed to the public, with a sign giving notice of the closure. Requires a report or documentation of the rescue to be submitted to the Department of the Attorney General. Effective 7/1/3000. (HD1)

RELATING TO THE DEPARTMENT OF HAWAIIAN HOME LANDS. Gives practical effect to the intent of the Legislature that funds appropriated in Act 279, Session Laws of Hawaii 2022, be available for expenditure until June 30, 2025.

RELATING TO THE DEPARTMENT OF TRANSPORTATION. Authorizes the Department of Transportation to acquire any real, personal, or mixed property for immediate or future use; own, hold, improve, rehabilitate, sell, assign, exchange, transfer, convey, lease, or dispose of any real, personal, or mixed property acquired; and acquire by condemnation real property for immediate or future use. Amends the definition of "public lands" to exclude lands to which the Department of Transportation holds title. Authorizes the Department of Transportation to directly acquire any real property for its purposes. Effective 7/1/3000. (HD1)

RELATING TO ROADS. Permits the counties to use county surcharge revenues for maintenance of private roadways that are open to the public. Requires the counties to use fuel taxes for reconstruction, improvement, repair, and maintenance of private roads that are open to the public. Effective 7/1/3000. (HD1)

RELATING TO HIGHWAY SAFETY. Establishes the Automated Speed Enforcement Systems Program. Authorizes the state or counties to administer the Automated Speed Enforcement Systems Program. Requires fines collected beginning 1/1/2025 for violations on a county highway to be expended for the operation of the Automated Speed Enforcement Systems Program. Creates a new offense of noncompliance with the posted speed limit under the Automated Speed Enforcement System. Appropriates funds. Effective 7/1/3000. (HD1)

RELATING TO DRIVING WHILE INTOXICATED. Establishes an intoxicated driving reduction working group to make recommendations for amendments to existing laws to reduce incidents of intoxicated driving. Effective 7/1/3000. (HD1)

RELATING TO 911 SERVICES. Deletes the term "enhanced" in reference to 911 services to allow funding of all 911 technologies. Allows the 911 Board to employ staff, in addition to the executive director, exempt from chapters 76 and 89, HRS.

RELATING TO PROCUREMENT. Requires cash or protest bonds to be returned to the initiating parties, minus administrative costs as determined by the Office of Administrative Hearings of the Department of Commerce and Consumer Affairs, except in cases where the appeal was frivolous or made in bad faith. Effective 7/1/3000. (HD1)

RELATING TO ALCOHOL. Expands the definition of "beer" under the liquor regulatory laws to mean any alcoholic beverage containing no less than 0.5 per cent alcohol by volume obtained by fermentation of any infusion or decoction of malt or any substitute, including alcohol seltzer beverages and excluding sake, cooler beverages, and other distilled products. Authorizes brewpubs to sell beer they manufacture, or beer manufactured on their premises, subject to certain conditions. Effective 1/1/2025.

RELATING TO FIRE PREVENTION. Increases the maximum fine for violations of the fire protection laws. Specifies that each day a violation exists or continues to exist shall constitute a distinct and separate offense. Raises the criminal penalty for the offense of arson in the fourth degree to a class C felony if the offense was committed during the time period and within the geographic area in which a red flag warning was in effect. Provides that the state of mind requirement is not applicable to the fact that the red flag warning was in effect and that the actor is strictly liable with respect to the attendant circumstance that the red flag warning was in effect.

RELATING TO CRIME. Clarifies that the secured areas appurtenant to a multi-unit dwelling are included as dwellings for the purposes of prosecuting offenses under chapter 708, Hawaii Revised Statutes. Allows the owner of a multi-unit building or the condominium association to act as a complainant for the purpose of investigating and prosecuting a burglary in the first degree in a multi-unit building.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony received after this time will be stamped late and left to the discretion of the chair to consider. While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.
Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
The chair may institute a per-testifier time limit.
Committees meeting in the morning must adjourn prior to the day's Floor Session. Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments. However, written submissions will be considered by the committee.
Please refrain from profanity or uncivil behavior. Violations may result in ejection from the hearing without the ability to rejoin.
