RELATING TO PHOTO RED LIGHT IMAGING DETECTOR SYSTEMS. Provides that any photo red light imaging detector system's clear and unobstructed recorded image of a motor vehicle license plate shall be prima facie evidence that the motor vehicle to which the license plate is attached is the motor vehicle for which the license plate was issued. Requires the State, the county, or the State's or county's third party contractor to implement a process to record the date on which the summons or citation was submitted to the post office, which shall be prima facie evidence of the date the summons or citation was submitted to the post office. Effective 7/1/3000. (HD1)

RELATING TO LAW ENFORCEMENT. Establishes a task force on ethical policing to evaluate the efficacy and impact of Weed and Seed programs. Requires a report to the Legislature.

RELATING TO THE HAWAIIAN HOMES COMMISSION ACT. Amends the Hawaiian Homes Commission Act of 1920, as amended, to increase the loan limit for direct loans provided by the Department of Hawaiian Home Lands from fifty per cent to seventy-five per cent of the maximum single residence loan amount allowed in Hawaii by the United States Department of Housing and Urban Development's Federal Housing Administration. Takes effect on either the date of the Secretary of the Interior's notification that congressional approval of this Act is unnecessary, or on the date of consent by the United States Congress. Effective 7/1/3000. (HD1)

RELATING TO FIRE PROTECTION. Authorizes the use of the reduced ignition propensity cigarette program special fund to support the State Fire Council and its programs and activities, including for the hiring of administrative personnel.

RELATING TO WEAPONS. Requires the Department of the Attorney General to publish certain annual reports regarding restraining orders, firearms, and electric guns. Authorizes persons subject to certain restraining orders to possess or control firearms, ammunition, or electric guns in the course of employment, subject to certain conditions.

RELATING TO THE TRAFFIC CODE. Specifies that the counties may issue traffic infractions for violations of any law prohibiting or restricting the stopping, standing, or parking of vehicles on all highways and county property. Authorizes stopping, standing, and parking restrictions and prohibitions on property under jurisdiction of the Director of Transportation and the counties, respectively.

RELATING TO PRIVATE SECURITY CONTRACTS. Effective January 1, 2024, transfers the responsibility and management of certain private security contracts from the Department of Law Enforcement to the Department of Defense, the Department of Health, and the Department of Human Services for their respective facilities.

RELATING TO TORT LIABILITY. Permanently reinstates the liability protections previously afforded to county lifeguards providing services at state beach parks or in the ocean.

PROPOSING AMENDMENTS TO ARTICLES VIII AND X OF THE CONSTITUTION OF THE STATE OF HAWAII TO AUTHORIZE THE LEGISLATURE TO ESTABLISH A SURCHARGE ON RESIDENTIAL INVESTMENT PROPERTY TO INCREASE FUNDING FOR PUBLIC EDUCATION. Proposes amendments to the Hawaii State Constitution to repeal the counties exclusive power to tax real property and increase funding for public education for the children and adults of Hawaii by authorizing the Legislature to establish, as provided by law, a surcharge on residential investment property valued at $3,000,000 or greater. Effective 7/1/3000. (HD1)

RELATING TO THE SAFETY OF EDUCATIONAL WORKERS. Requires the Department of Education and public charter schools to take certain steps to report incidents of harassment and implement procedures for handling harassment of educational workers. Creates the offense of harassment of an educational worker. Effective 7/1/3000. (HD1)

RELATING TO EDUCATION. Establishes a harm to students registry for all preschools and K-12 educational institutions within the State that contains information on school employees, contractors, or volunteers for whom, as result of an investigation, a final finding has been issued that the individual has inflicted harm on a student. Defines "inflicted harm on a student". Allows for an appeal process to remove an individual's name from the registry. Appropriates funds. Effective 7/1/3000. (HD1)

RELATING TO YOUTH FEES AND FINES. Prohibits the assessment of any fees, fines, or court costs against a person who was adjudicated for an offense committed during the person's minority, or against the person's parent or guardian, and discharges all related debt obligations assessed prior to the effective date of the Act. Effective 7/1/3000. (HD1)

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony received after this time will be stamped late and left to the discretion of the chair to consider. While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.
Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
The chair may institute a per-testifier time limit.
Committees meeting in the morning must adjourn prior to the day's Floor Session. Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments. However, written submissions will be considered by the committee.
Please refrain from profanity or uncivil behavior. Violations may result in ejection from the hearing without the ability to rejoin.
For remote testifiers, the House will not be responsible for bad connections on the testifier's end.
