On June 12, 1974, Hawaii became the first state in the nation to enact employer-based health care insurance, setting minimum standards of health care benefits for workers.  The purpose of this briefing is to provide an overview of the history of the Hawaii Prepaid Health Care Act, its requirements and the regulatory framework that has been in place for nearly fifty years ensuring access to affordable health care for Hawaii's residents and families.

 

Additionally, this briefing will provide an overview of the Employee Retirement Income Security Act and the exemption for Hawaii's Prepaid Health Care Act, the enactment and implementation of the federal Patient Protection and Affordable Care Act, also referred to as the Affordable Care Act or "ACA", and how these laws interact with Hawaii's Prepaid Health Care Act.  Participants have been asked to brief the Committee and the public on issues including but not limited to: (1) the requirements for Essential Health Benefits ("EHBs") in Hawaii; (2) waivers received from the federal government specific to Hawaii's health insurance marketplace; (3) proposed federal rules related to EHBs and future designation of EHBs; (4) the issue of defrayment by states for new state mandated health insurance benefits; and (5) the potential impacts of ACA litigation on the design, benefits, and coverage of health insurance in Hawaii.
