RELATING TO TOBACCO PRODUCTS. Prohibits the sale of flavored tobacco products and mislabeled e-liquid products that contain nicotine. Repeals language making the sale of cigarettes, tobacco products, and electronic smoking devices a statewide concern and preempting county ordinances and regulations. Effective 1/1/2025.

RELATING TO TOBACCO PRODUCTS. Repeals existing law that preempted local ordinances or regulations that regulate the sale of cigarettes, tobacco products, and electronic smoking devices and nullified and voided any conflicting local laws and regulations. Allows counties to adopt ordinances that regulate the sale of cigarettes, tobacco products, and electronic smoking devices that do not conflict with and are more stringent than the state law that governs smoking.

RELATING TO OPIOID LITIGATION PROCEEDS. Establishes the Hawaii opioid litigation proceeds special fund. Establishes the Hawaii opioid litigation proceeds council to administer the special fund. Establishes standards for expenditure of opioid litigation proceeds received by the State. Establishes and appropriates funds for three full-time equivalent positions.

RELATING TO HEALTH. Requires law enforcement officers to carry an opioid antagonist while on-duty. Authorizes law enforcement officers to administer an opioid antagonist. Establishes immunity for law enforcement officers who administer an opioid antagonist during an opioid-related drug overdose. Requires Department of Health to establish education and training for law enforcement personnel. Requires the Department of Health to require that all restaurants and hotel establishments maintain an inventory of naloxone.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony received after this time will be stamped late and left to the discretion of the chair to consider. While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.
Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
The chair may institute a per-testifier time limit.
Committees meeting in the morning must adjourn prior to the day's Floor Session. Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments. However, written submissions will be considered by the committee.
Please refrain from profanity or uncivil behavior. Violations may result in ejection from the hearing without the ability to rejoin.
For remote testifiers, the House will not be responsible for bad connections on the testifier's end.
