RELATING TO THE GENERAL EXCISE TAX. Exempts medical and dental services provided by health care providers to patients who receive Medicaid, Medicare, or TRICARE benefits from the general excise tax. Applies to taxable years beginning after 12/31/2023. Effective 6/30/3000. (HD1)

RELATING TO TAXATION. Amends the definition of Hawaii taxable estate to provide that the marital deduction under section 2056 of the Internal Revenue Code shall apply to the passage of any interest in property to any immediate family member. Amends the state generation-skipping transfer tax law to provide that a transfer to any immediate family member shall not be considered a distribution to a skip person, as defined in section 2613 of the Internal Revenue Code. RELATING TO PASS-THROUGH ENTITY TAXATION. For taxable years beginning after 12/31/2023, adds a definition for "qualified member" and repeals the definitions for "direct member" and "indirect member" as used in the State's pass-through entity taxation election law. For pass-through entities electing to pay Hawaii income taxes at the entity level, allows certain qualified members entitled to a tax credit to use the credit against the member's net income tax liability in subsequent years until exhausted.

RELATING TO THE PUBLIC UTILITIES COMMISSION. Establishes system resilience as a metric to be monitored and considered by the Public Utilities Commission. Authorizes the use of amounts collected through the Hawaii electricity reliability surcharge by the Commission to perform certain duties. Effective 7/1/3000. (HD1)

RELATING TO THE RESEARCH CORPORATION OF THE UNIVERSITY OF HAWAII. Clarifies the purpose of the Research Corporation of the University of Hawaii and that its undertakings shall be limited to acts that are reasonably necessary to carry out its purpose. Repeals the requirement that the University of Hawaii contract with the Research Corporation when the University determines that other various agencies cannot more effectively or efficiently accomplish certain research and training activities. Grandfathers existing Research Corporation contracts and requires new contracts be subject to new limitations. Limits the scope of the special account the Research Corporation is authorized to establish. Requires revolving accounts to follow University of Hawaii Administrative Procedure 12.204. Limits internal service orders and revolving accounts of the Research Corporation that use University intramural funds to certain projects and requires biannual reports to the Legislature. Effective 7/1/2050. (HD1)

RELATING TO CONDOMINIUMS. Requires the Legislative Reference Bureau to conduct a study on how certain other states approach the following subjects as they relate to condominiums: an ombudsman, licenses for management, alternative dispute resolution, governmental regulation, owner education, and owner access to documents. Extends the deadline for the final report and the cease date for the Condominium Property Regime Task Force to 6/30/2026. Appropriates funds. Effective 7/1/3000. (HD1)

RELATING TO CRISIS SERVICES. Establishes a Crisis Intervention and Diversion Services Program within the Department of Health to expand existing services to divert those with mental health issues to appropriate health care services. Requires the Department of Law Enforcement to coordinate crisis intervention training for state and county law enforcement agencies and training and certification for crisis intervention officers. Defines "mental health emergency worker" and "crisis intervention officer". Appropriates funds. Effective 7/1/3000. (HD2)

RELATING TO HOMELESSNESS. Establishes a working group to develop a Homeless Triage and Treatment Center Program within the Statewide Office of Homelessness and Housing Solutions in the Department of Human Services. Appropriates funds. Effective 7/1/2050. (HD1)

RELATING TO THE DEPARTMENT OF HAWAIIAN HOME LANDS. Gives practical effect to the intent of the Legislature that funds appropriated in Act 279, SLH 2022, be available for expenditure until 6/30/2025. Appropriates funds. Effective 7/1/2050. (HD1)

RELATING TO INTERNSHIPS. Permits the Department of Labor and Industrial Relations to enter into contracts with eligible employers or registered apprenticeship programs in the private sector to provide on-the-job training to eligible interns. Requires the Department of Human Resources Development to collaborate with the Department of Labor and Industrial Relations for certain portions of the on-the-job-training work experience program. Provides that the State shall be the responsible employer for purposes of workers' compensation coverage for students or recent graduates in the on-the-job-training work experience program, subject to certain limitations. Appropriates funds. Effective 7/1/3000. (HD2)

RELATING TO COUNTY LABOR STANDARDS. Authorizes the counties to require employers to disclose information regarding its employees' wages, benefits, hours, and employment status and deny, revoke, or suspend a building permit application for violating laws relating to wages, benefits, hours, and employment status, under certain conditions. Effective 7/1/3000. (HD2)

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony received after this time will be stamped late and left to the discretion of the chair to consider. While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.
Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
The chair may institute a per-testifier time limit.
Committees meeting in the morning must adjourn prior to the day's Floor Session. Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments. However, written submissions will be considered by the committee.
Please refrain from profanity or uncivil behavior. Violations may result in ejection from the hearing without the ability to rejoin.
