RELATING TO BURIAL SITES.

Imposes a fine on any private landowner that fails to disclose or record with the Bureau of Conveyances, or in documents used to offer real property for sale, the existence of burial or archaeological sites on their property that the landowner knew or should have known of.  Requires fines collected to be deposited into the Hawaii Historic Preservation Special Fund.  Effective 7/1/3000.  (HD1)

RELATING TO THE LAND TRUST ACT.

Clarifies that if no personal property designation appears in a recorded instrument, the interests of the beneficiaries shall be real property.  Effective 7/1/3000.  (HD1)

RELATING TO THE HAWAIIAN HOMES COMMISSION ACT.

Amends the Hawaiian Homes Commission Act to authorize the Department of Hawaiian Home Lands to provide cash awards to beneficiaries on the waiting list in lieu of a lease.  Amends the Hawaiian Home Loan Fund to be allow for the use of cash award payments.  Requires the Department of Hawaiian Home Lands to remove those beneficiaries from the waiting list.  Specifies that beneficiaries who accept a cash reward shall lose their right to return to the waiting list, but remain entitled to other rights provided by the Hawaiian Homes Commission Act.  Effective 7/1/3000.  (HD1)

RELATING TO TAX ENFORCEMENT.

Provides deadlines for taxpayers under audit to comply with demands to produce documents and evidence.  Requires the Tax Appeal Court to preclude documents or evidence not produced pursuant to a demand from being introduced in evidence in a tax appeal or action unless the failure was due to reasonable cause.  Effective 7/1/3000.  (HD1)

PROPOSING AN AMENDMENT TO ARTICLE VI, SECTION 3 OF THE HAWAII CONSTITUTION TO MAKE THE SENATE CONFIRMATION PROCESS FOR JUDICIAL APPOINTMENTS MORE UNIFORM.

Proposes amendments to the Constitution of the State of Hawaii relating to the appointment of justices and judges.  Makes the appointment and senate consent procedure for district court judges the same as the appointment and senate consent procedure for supreme court justices and intermediate court of appeals and circuit court judges.  Effective 7/1/3000.  (HD1)

Establishes a phased process for adjusting the reporting period for gift disclosures filed with the State Ethics Commission to conform with the fiscal year.  Provides for electronic filing of documents required by the State Ethics Commission.  Effective 7/1/3000.  (HD1)

RELATING TO CAMPAIGN FINANCE.

Allows campaign funds to be used for a candidate's child care and vital household dependent care costs under certain conditions.  Effective 7/1/3000.  (HD1)

RELATING TO LEGAL REPRESENTATION.

Allows a court to appoint an attorney for the subject of a petition for assisted community treatment if the interests of justice require one be appointed.  Repeals language that entitles the subject of a petition for assisted community treatment to legal representation by a public defender.  Effective 7/1/3000.  (HD1)

RELATING TO SOLICITATION OF FUNDS FROM THE PUBLIC.

Regulates charitable fundraising platforms and activities of platform charities.  Includes provisions relating to the misuse of funds.  Imposes vicarious liability upon a platform charity for a charitable fundraising platform's misuse of funds, and vice versa.  Effective 1/1/3000.  (HD1)

RELATING TO EXCLUSIVE LISTING AGREEMENTS.

Makes certain long-term exclusive listing agreements for the sale of residential real property void and unenforceable under the state law that governs unfair and deceptive practices.  Prohibits the recording or filing of exclusive listing agreements of any duration with the Bureau of Conveyances.  Establishes certain remedies.  Effective 7/1/3000.  (HD1)

RELATING TO MEDICAL CANNABIS.

Specifically authorizes a medical cannabis dispensary to purchase cannabis and manufactured cannabis products from another dispensary.  Requires the Department of Health to adopt rules regarding medical cannabis products within a certain time.  Effective 7/1/3000.  (HD1)

RELATING TO SEX TRAFFICKING.

Authorizes civil claims to be made against a business, owner of a business, or operator of a business that profits from sexual exploitation.  Effective 7/1/3000.  (HD1)

RELATING TO SEXUAL ABUSE OF MINORS.

Expands the time period by which a civil action for childhood sexual abuse committed on or after July 1, 2024, may be initiated.  Authorizes a court to require personnel of legal entities to undergo training on trauma-informed response.  Effective 7/1/3000.  (HD1)

Status

RELATING TO LIMITATION OF ACTIONS.

Extends the statute of limitations for civil actions brought by adults subjected to sexual offenses for a one-year period.  Allows a claim to be brought against legal entities during the one-year period if there is a finding of gross negligence.  Authorizes a court to award attorney's fees to a defendant when an accusation of sexual abuse was made with no basis in fact and with malicious intent.  Effective 7/1/3000.  Sunsets 7/1/2025.  (HD1)

DECISION MAKING TO FOLLOW

 

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  Testimony received after this time will be stamped late and left to the discretion of the chair to consider.  While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.

 

Testimony submitted will be placed on the legislative website.  This public posting of testimony on the website should be considered when including personal information in your testimony.

 

The chair may institute a per-testifier time limit.

 

Committees meeting in the morning must adjourn prior to the day's Floor Session.  Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments.  However, written submissions will be considered by the committee.

 

Please refrain from profanity or uncivil behavior.  Violations may result in ejection from the hearing without the ability to rejoin.

 

For remote testifiers, the House will not be responsible for bad connections on the testifier's end.
