Makes an emergency appropriation from the Mental Health and Substance Abuse Special Fund to the Department of Health to implement quality improvement recommendations at the Hawaii State Hospital.  Effective 7/1/3000.  (HD1)

RELATING TO OPIOID LITIGATION PROCEEDS.

Establishes the Hawaii opioid litigation proceeds special fund.  Establishes the Hawaii opioid litigation proceeds council to oversee the Hawaii opioid settlement advisory committee's expenditure of opioid litigation proceeds.  Establishes standards for expenditure of opioid litigation proceeds received by the State.  Establishes and appropriates funds from the Hawaii opioid litigation proceeds special fund for staff positions.  Effective 7/1/3000.  (HD2)

RELATING TO FUNDING FOR THE TOBACCO ENFORCEMENT SPECIAL FUND.

Increases the ceiling for the Tobacco Enforcement Special Fund from $500,000 to $750,000.  Increases the cigarette tax stamp fee and the percentage of the cigarette tax stamp fee deposited to the Tobacco Enforcement Special Fund.  Increases the amount to be deposited to the credit of the Tobacco Enforcement Special Fund from tobacco settlement moneys.  Effective 7/1/3000.  (HD1)

RELATING TO THE NURSE LICENSURE COMPACT.

Allows the Governor to enter the State into the multistate Nurse Licensure Compact, which will allow a nurse who is licensed by a home state to practice under a multistate licensure privilege in each party state.  Beginning 1/1/2026, allows the State Board of Nursing to charge different fees customarily and historically charged for registered nurses and licensed practical nurses who hold a multistate license issued by the State.  Effective 7/1/3000.  (HD2)

RELATING TO MENTAL HEALTH.

Establishes provisional or associate-level licensure requirements for marriage and family therapists, mental health counselors, and psychologists and authorizes insurance reimbursements in certain circumstances.  Requires psychologist license applicants to possess a doctoral degree and complete certain supervised experience requirements before sitting for the licensing examination.  Authorizes insurance reimbursements for services provided by a supervised social work intern in certain circumstances.  Appropriates funds.  Parts II, III, IV, and V effective 7/1/2026.  Effective 7/1/3000.  (HD1)

Authorizes examination of defendants via telehealth.  Amends conditions for certain petty misdemeanants' release or examination of fitness to proceed.  Provides a mechanism for the automatic screening of certain nonviolent defendants for involuntary hospitalization or assisted community treatment.  Appropriates funds.  Effective 7/1/3000.  (HD2)

RELATING TO MENTAL HEALTH.

Part I:  requires the Department of the Attorney General to assist with the preparation and filing of petitions for assisted community treatment and with the presentation of the case, unless declined by the petitioner.  Part II:  repeals language entitling the subject of a petition for assisted community treatment to legal representation by a public defender.  Part III:  provides a mechanism for the automatic screening of certain nonviolent defendants for involuntary hospitalization or assisted community treatment.  Part IV:  authorizes courts to require certain probation violators to undergo a mental health evaluation and treatment program as a condition of continued probation.  Effective 7/1/3000.  (HD2)

Establishes a vacated homeless encampment clean up task force to identify parcels of land that require intergovernmental coordination to clean up vacated homeless encampments located on lands managed by government agencies, including but not limited to the United States Army Garrison Hawaii, and execute a memorandum of understanding to clean up vacated homeless encampments located on the identified parcels.  Requires reports to the Legislature.  Appropriate funds.  Effective 7/1/3000.  (HD1)

RELATING TO MEDICAL TRANSPORTATION.

Establishes within the Department of Health a 2-year pilot project to charter flights from rural islands to an urban island to provide rural island residents with reliable transportation to medical care on urban islands.  Appropriates funds.  Sunsets 6/30/2026.  Effective 7/1/3000.  (HD1)

RELATING TO MICROENTERPRISE KITCHENS.

Establishes a regulatory framework for microenterprise home kitchens.  Authorizes the Department of Health to adopt rules regarding microenterprise home kitchens; grant and revoke permits; issue food safety manager certificates; charge fees; and conduct inspections.  Appropriates funds.  Effective 7/1/3000.  (HD1)

The chair may institute a per-testifier time limit.

 

Committees meeting in the morning must adjourn prior to the day's Floor Session.  Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments.  However, written submissions will be considered by the committee.
