RELATING TO RENT CREDITS FOR DEMOLITION AND INFRASTRUCTURE COSTS ON PUBLIC LAND LEASES.

Repeals the sunset provision of Act 222, Session Laws of Hawaii 2021, to permanently allow the Board of Land and Natural Resources to approve rent credits for demolition and infrastructure costs for public land leases.  Effective 7/1/3000.  (HD1)

RELATING TO ADMINISTRATIVE FEES.

Statutorily establishes a Department of Land and Natural Resources transaction fee for each recording in the Bureau of Conveyances and Land Court.  Authorizes the Board of Land and Natural Resources to adopt, amend, or repeal administrative fees, including transaction fees, for recordings in the Bureau of Conveyances and Land Court separate from the administrative rulemaking process.  Amends the authorized uses of moneys in the bureau of conveyances special fund.  Repeals language that required the Bureau of Conveyances' microfilm fees to be established by rules.  Effective 1/1/3000.  (HD2)

RELATING TO THE PACIFIC MARINE FISHERIES COMPACT.

Authorizes the Governor to execute a compact on behalf of the State to cooperate in the Pacific States Marine Fisheries Commission.  Establishes procedures for selection and succession of commissioners.  Effective 7/1/3000.  (HD1)

RELATING TO THE HILO COMMUNITY ECONOMIC DISTRICT.

Clarifies that the Board of Land and Natural Resources shall not unilaterally amend the terms and conditions of any lease of public lands being extended pursuant to Act 149, Session Laws of Hawaii 2018, except as otherwise provided therein; and if the Board of Land and Natural Resources wishes to amend the terms and conditions of any lease of public lands being extended to reflect the Board's most current lease form and leasing practices and policies, such lease form and leasing practices and policies must be included in the rules of the Board.  Defines "lease of public lands".  Repeals 6/30/2028.  Effective 7/1/3000.  (HD1)

RELATING TO STATE BOATING FACILITIES.

Establishes a state boating facility lease pilot program within the Department of Land and Natural Resources to lease one state small boat harbor for private development, management, maintenance, and operation in a county with a population of less than 900,000.  Repeals provisions related to the leasing of fast lands and submerged lands of the Ala Wai boat harbor.  Repeals on 6/30/2044.  Effective 7/1/3000.  (HD1)

RELATING TO COMMERCIAL OCEAN RECREATION OPERATIONS.

Specifies that the Department of Land and Natural Resources shall issue all new commercial use permits for commercial ocean recreation activity in an ORMA that are not renewals or reissuances by public auction.  Revises provisions relating to boating and ocean recreation fees and permits.  Effective 7/1/3000.  (HD1)

RELATING TO STATE WATER CODE PENALTIES.

Adds a minimum penalty and amends the maximum penalty per violation of the State Water Code, expands the types of potential violations of the State Water Code, and makes each day that a violation exists or continues to exist a separate offense.  Requires the Commission on Water Resource Management to consider certain factors when imposing penalties.  Makes the setting, charging, and collecting of administrative fines by the Commission on Water Resource Management mandatory, rather than discretionary.  Effective 7/1/3000.  (HD1)

RELATING TO WATER.

Requires each county board of water supply or water board to prioritize the sustainable recharge of aquifers, ensure the health of watersheds, and, when allocating water for new development, prioritize the development of affordable housing over other types of development.  Provides that these requirements shall not be construed to affect allocations of water for agricultural purposes or developments under the Hawaiian Homes Commission Act, 1920, as amended.  Effective 7/1/3000.  (HD1)

RELATING TO BEACH MANAGEMENT ON THE NORTH SHORE OF OAHU.

Appropriates funds to the university of Hawaii sea grant college program to develop a north shore beach management and climate adaptation plan for the north shore of Oahu from Sunset point to the Kapoʻo (Sharks Cove) area.  Appropriates funds.  Effective 7/1/3000.  (HD1)

RELATING TO THE HAWAII COMMUNITY DEVELOPMENT AUTHORITY.

Establishes the Panaewa Community Development District to allow for planning, development, and maintenance of public lands in Panaewa, Hawaii.  Amends membership of the Hawaii Community Development Authority to include representatives of the Panaewa Community Development District.  Effective 7/1/3000.  (HD2)

RELATING TO SEARCH AND RESCUE.

Repeals the existing conditions under which government entities may seek reimbursement for search or rescue expenses and instead requires a government entity of the State to impose and collect a fee for search or rescue expenses for persons who require rescue after leaving a hiking trail to enter an area closed to the public or hiking on a trail closed to the public, with a sign giving notice of the closure.  Requires a report or documentation of the search and rescue to be submitted to the Department of the Attorney General.  Effective 7/1/3000.  (HD2)

The chair may institute a per-testifier time limit.

 

Committees meeting in the morning must adjourn prior to the day's Floor Session.  Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments.  However, written submissions will be considered by the committee.
