RELATING TO STATE TAX ADMINISTRATION. Repeals an obsolete fee for a certified copy of a tax clearance. Adds a penalty for failure to comply with reporting requirements under general excise tax law and transient accommodations tax law for collection of rent by a third party. Allows for the interest earned on payments under protest in the litigated claims fund to be paid in nontaxation cases if the claimant prevails. Establishes a procedure for the disposition of moneys and refiling of actions when a payment under protest suit is filed prematurely. Effective 7/1/3000. (HD1)

RELATING TO THE PENAL CODE. Requires the Judicial Council to conduct a comprehensive review of the Hawaii Penal Code and to recommend proposed changes. Requires the Judicial Council to appoint an advisory committee to assist in the review, and allows the Council to also appoint a reporter and other staff as necessary. Requires the advisory committee to report to the Legislature. Appropriates funds. Effective 7/1/3000. (HD1)

RELATING TO ATTORNEYS. Requires petitions or motions for a pro hac vice appearance for a court or arbitration proceeding to be supported by certain evidence to ensure that both the applicant and local counsel will pay all state income tax due for Hawaii business activities as well as any other information or documentation required by the Rules of the Supreme Court of the State of Hawaii. RELATING TO THE TRAFFIC CODE. Authorizes stopping, standing, and parking restrictions and prohibitions on property under jurisdiction of the Director of Transportation and the counties, respectively. Specifies that the counties may issue traffic infractions for violations of any law prohibiting or restricting the stopping, standing, or parking of vehicles on all highways and county property. RELATING TO LAW ENFORCEMENT. Establishes as a goal of the State the increased representation of female law enforcement officers in the State by 2030. Requires each law enforcement agency to recruit law enforcement officers from diverse backgrounds.

RELATING TO THE DEPARTMENT OF LAW ENFORCEMENT. Expands the requirement that the Department of Law Enforcement pursue and obtain accreditation from the Commission on Accreditation for Law Enforcement Agencies, Inc., to all divisions and sections within the Department. Establishes five CALEA coordinator positions, exempt from civil service, within the Department of Law Enforcement. (HD1)

RELATING TO LAW ENFORCEMENT. Requires the Law Enforcement Standards Board to develop, and each department employing law enforcement officers to implement, a structured health intervention program to support law enforcement officers' physical and mental health. Effective 7/1/3000. (HD1)

RELATING TO FIREWORKS. Authorizes law enforcement and fire officers to enter and inspect any licensee's or permittee's premises, under certain conditions, to verify compliance with the State's Fireworks Control Law. Establishes procedures for the Department of Law Enforcement to conduct administrative inspections of controlled premises. Requires certain licensees and permittees to keep records and maintain inventories. Requires licensees and permittees to report any stolen fireworks or articles pyrotechnic. Authorizes a law enforcement agency or county fire department to safely dispose confiscated fireworks and articles pyrotechnic. Requires violators to be held liable for storage and disposal costs. Specifies that each type of prohibited firework constitutes a separate violation. Authorizes the Department of Law Enforcement, in addition to the counties, to enforce the Fireworks Control Law. Appropriates funds. Effective 7/1/3000. (HD1)

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony received after this time will be stamped late and left to the discretion of the chair to consider. While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.
Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
The chair may institute a per-testifier time limit.
Committees meeting in the morning must adjourn prior to the day's Floor Session. Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments. However, written submissions will be considered by the committee.
Please refrain from profanity or uncivil behavior. Violations may result in ejection from the hearing without the ability to rejoin.
