RELATING TO WASTEWATER. Requires each county to develop and maintain a wastewater management plan. Specifies the requirements of the wastewater management plan. Authorizes the Director of Health to exempt a county from creating a wastewater management plan if the county has an existing plan that substantially meets certain requirements. Requires the counties to identify specific priority areas in which the county sewerage system or other centralized treatment system will be expanded or constructed to reduce or eliminate cesspools before 1/1/2050. Provides for the designation of these priority areas as sewer improvement districts. Authorizes each county to assess a monthly cesspool pollution fee beginning in 7/1/2025 on real properties containing a cesspool. Authorizes the counties to use fee revenues for certain activities that eliminate, reduce, or mitigate the impacts of cesspools, including the expansion of county sewerage systems and the issuance of grants and low-interest loans to property owners. Declares that the appropriation exceeds the state general fund expenditure ceiling for 2024-2025. Makes appropriations.

RELATING TO CESSPOOLS. Establishes a three-year new wastewater system demonstration and implementation pilot program within the University of Hawaii Sea Grant College.

RELATING TO FINANCING. Establishes a cesspool conversion on-bill financing program to be administered by the Hawaii green infrastructure authority to provide low-interest loans to eligible homeowners for the upgrade, conversion, or connection of cesspools.

RELATING TO CESSPOOLS. Requires cesspools attached to or used by housing or lodging that provides transient accommodations to be upgraded, converted, or connected to a sewerage system before 1/1/2030.

RELATING TO CESSPOOLS. Authorizes and appropriates funds to the Department of Health to retain qualified consultants as necessary to identify necessary public outreach and education resources and tools and develop a comprehensive public outreach strategy and website to educate homeowners and wastewater industry professionals about information and resources regarding the State's cesspool upgrade, conversion, and connection requirements and deadlines. Requires that mandatory seller disclosures in real estate transactions include whether the property has a cesspool, including the date by which state law mandates that the cesspool be upgraded, converted, or connected, and the priority level of the cesspool according to the Hawaii cesspool hazard assessment and prioritization tool.

RELATING TO THE ENVIRONMENT. Requires individual wastewater systems that are near the shoreline, or likely to pollute groundwater, to include denitrification capacity.

RELATING TO CESSPOOLS. Part II: Requires certain priority level 1 cesspools to be upgraded, converted, or connected before 1/1/2035, and priority level 2 cesspools to be upgraded, converted, or connected before 1/1/2045, rather than before 1/1/2050. Part III: Appropriates funds to implement the cesspool compliance pilot grant project established pursuant to Act 153, Session Laws of Hawaii 2022. Part IV: Establishes an income tax credit for the cost of upgrading or converting a qualified cesspool to a director of health-approved wastewater system or connecting to a sewerage system.

RELATING TO CESSPOOL CONVERSIONS. Amends Act 153, Session Laws of Hawaii 2022, to increase the cesspool compliance pilot grant project grant amount and update a reference. Appropriates funds for fiscal year 2024-2025 and to establish positions to implement the pilot grant project.

RELATING TO CESSPOOL CONVERSIONS. Establishes and appropriates funds for two full-time positions to implement the Cesspool Compliance Pilot Grant Project established by Act 153, SLH 2022, and makes an appropriation for the project for FY 2024-2025. Declares that the general fund expenditure ceiling is exceeded.

RELATING TO RENEWABLE ENERGY. Requires state facilities to prepare a report assessing the feasibility of installing distributed energy resource systems at each facility. Requires state facilities to implement and install the distributed energy resource systems detailed in the reports no later than five years from the issue date of the reports. Assigns priority for the required energy efficiency measures to first responder facilities.

RELATING TO RENEWABLE ENERGY. Requires contested cases or environmental impact statement cases involving renewable energy, except cases involving incineration, to be appealed from an agency's decision directly to the Hawaii Supreme Court for final decision. Requires the cases to be prioritized and decided expeditiously.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony received after this time will be stamped late and left to the discretion of the chair to consider. While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.
Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
The chair may institute a per-testifier time limit.
Committees meeting in the morning must adjourn prior to the day's Floor Session. Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments. However, written submissions will be considered by the committee.
Please refrain from profanity or uncivil behavior. Violations may result in ejection from the hearing without the ability to rejoin.
