      Status & Testimony

RELATING TO CESSPOOLS.

Part II: Requires certain priority level 1 cesspools to be upgraded, converted, or connected before 1/1/2035, and priority level 2 cesspools to be upgraded, converted, or connected before 1/1/2045, rather than before 1/1/2050.  Part III: Appropriates funds to implement the cesspool compliance pilot grant project established pursuant to Act 153, Session Laws of Hawaii 2022.  Part IV: Establishes an income tax credit for the cost of upgrading or converting a qualified cesspool to a director of health-approved wastewater system or connecting to a sewerage system.

      Status & Testimony

RELATING TO CESSPOOLS.

Authorizes and appropriates funds to the Department of Health to retain qualified consultants as necessary to identify necessary public outreach and education resources and tools and develop a comprehensive public outreach strategy and website to educate homeowners and wastewater industry professionals about information and resources regarding the State's cesspool upgrade, conversion, and connection requirements and deadlines.  Requires that mandatory seller disclosures in real estate transactions include whether the property has a cesspool, including the date by which state law mandates that the cesspool be upgraded, converted, or connected, and the priority level of the cesspool according to the Hawaii cesspool hazard assessment and prioritization tool.

      Status & Testimony

RELATING TO SUPPLEMENTAL NUTRITION ASSISTANCE PROGRAM INCENTIVES.

Appropriates funds to the Department of Agriculture for the continued administration of the Hawaii Healthy Food Incentive Program and to provide matching funds to beneficiaries who participate in the Supplemental Nutrition Assistance Program.  Declares that the general fund expenditure ceiling is exceeded.

RELATED TO TOXIC CHEMICALS.

Establishes a working group to investigate the existence and environmental dangers of per- and polyfluoroalkyl substances and related chemicals.  Requires a report to the Legislature.

RELATING TO MEAT PROCESSING.

Requires the Department of Agriculture to establish industry standards for processing meat and conduct a survey on slaughterhouse operations.  Establishes a tax credit for processing meat.  Makes an appropriation.

RELATING TO AQUACULTURE.

Requires the Department of Health to amend its shellfish sanitation administrative rules based on the United States Department of Agriculture's 2019 National Shellfish Sanitation Program model ordinance.

RELATING TO HEALTH.

Requires waste combustion facility owners to implement continuous monitoring and sampling technologies for the purposes of collecting data regarding emissions.  Establishes a publicly available website hosted by the Department of Health that will track and display data collected on emissions.  Requires the DOH to adjust permit limits for air contaminants based on emissions data collected.  Requires reports to the legislature.  Declares that the general fund expenditure is exceeded.  Makes an appropriation.

RELATING TO THE ENVIRONMENT.

Requires the department of health to conduct a statewide needs assessment to inform the future establishment of an extended producer responsibility program for packaging waste.  Appropriates funds.

RELATING TO FERAL CHICKENS.

Appropriates funds to the City and County of Honolulu and the Department of Health for a feral chicken control program and a feeding of feral animals education program, respectively.  Declares that the general fund expenditure ceiling is exceeded.

RELATING TO WATER QUALITY.

Requires the Department of Health to require continued water testing during brown water advisories under certain circumstances.

RELATING TO CRIMINAL HISTORY RECORD CHECKS.

Authorizes the Department of Health to conduct fingerprinting and criminal history record checks of applicants who apply for a permit to operate as a hemp processor.
