A BILL FOR AN ACT

 

 

relating to motor vehicle safety inspections.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that requiring vehicle owners to present a valid certificate of registration in order to receive a certificate of inspection creates an arduous three-step process if the owner's certificates of inspection and registration are both expired.  First, the vehicle owner must schedule an appointment with an inspection station and receive a failed safety inspection to certify that the owner has satisfied all of the requirements of the inspection, except the certificate of registration.  Then, the owner must present to the appropriate county department having jurisdiction over motor vehicle registration the failed safety check and all other required documents.  Finally, the owner must return to the initial inspection station to receive a completed certificate of inspection.  This process creates extra traffic on the road, unnecessary complications for the vehicle owners, and extra work for safety inspection stations.

     The legislature further finds that the majority of states do not require a safety inspection at all, and the ones that do require a safety inspection typically do not require a certificate of registration in order to receive a certificate of inspection.

     Accordingly, the purpose of this Act is to require the department of transportation to amend its administrative rules to repeal any provisions requiring the furnishing of evidence of registration as a condition precedent to receiving a certificate of inspection.

     SECTION 2.  The department of transportation shall amend its rules pursuant to chapter 91, Hawaii Revised Statutes, to repeal any provisions requiring the furnishing of evidence of a motor vehicle's registration, including a certificate of registration, as a condition precedent to the issuance of a certificate of inspection pursuant to section 286-26, Hawaii Revised Statutes.

     SECTION 3.  This Act shall take effect upon its approval.
