A BILL FOR AN ACT

 

 

relating to firearms.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 707, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§707-    Brandishing a firearm.  (1)  A person commits the offense of brandishing a firearm if the person:

     (a)  Indicates, by word or conduct, that the person is carrying a firearm;

     (b)  Reveals or exhibits a firearm; or

     (c)  Draws or holds a firearm;

with the intent to terrorize, or in reckless disregard of the risk of terrorizing, another person. 

     (2)  Brandishing a firearm is a misdemeanor."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
