A BILL FOR AN ACT

 

 

relating to parental rights.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The Hawaii Revised Statutes is amended by adding a new chapter to be appropriately designated and to read as follows:

"Chapter

parental rights protection act

     §   -1  Short title.  This chapter may be cited as the Parental Rights Protection Act.

     §   -2  Parental rights; protected.  (a)  The liberty of a parent to direct the upbringing, education, care, and welfare of a parent's child shall be a fundamental right.

     (b)  The State, counties, or any political subdivision thereof shall not infringe on the right under subsection (a) without demonstrating a compelling governmental interest by the least restrictive means.

     §   -3  Applicability.  This chapter shall apply to any state law or regulation whether statutory or other and whether adopted or effective prior to or after the effective date of this chapter."

     SECTION 2.  This Act shall take effect upon its approval.

Description:

Establishes the Parental Rights Protection Act, which makes the liberty of a parent to direct the upbringing, education, care, and welfare of a parent's child a fundamental right.  Prohibits the State, counties, or any political subdivision thereof from infringing on the fundamental right without demonstrating a compelling governmental interest by the least restrictive means.
