A BILL FOR AN ACT

 

 

relating to motorcycles.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 291C, Hawaii Revised Statutes, is amended by adding a new section to part XIV to be appropriately designated and to read as follows:

     "§291C-    Operating motorcycles on the designated shoulder.  (a)  All motorcycles are entitled to full use of the shoulder; provided that the shoulder is a minimum of three feet wide and the operator of a motorcycle shall use emergency flashers while traveling on the shoulder.

     (b)  The department of transportation shall create traffic control devices to designate shoulder usage for motorcycles during peak traffic hours."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.

Description:

Authorizes operators of motorcycles to utilize the lane shoulders that are at least three feet wide with the concurrent use of emergency flashers.  Requires the Department of Transportation to create and implement traffic control devices to designate the lane shoulder for motorcycle use during peak traffic hours.
