A BILL FOR AN ACT

 

 

RELATING TO ANIMALS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 142, Hawaii Revised Statutes, is amended by adding a new section to part IV to be appropriately designated and to read as follows:

     "§142-     Marine mammals; commercial performances; prohibited.  (a)  No person shall promote, arrange, conduct, assist in, receive money for, or take part in any meeting, competition, exhibition, pastime, practice, display, or event at or in the course of which a captive marine mammal is used for performance for entertainment purposes.

     (b)  This section shall not be construed to prohibit a person from holding a marine mammal for research or rehabilitation purposes.

     (c)  As used in this section, "marine mammal" includes monk seals and any species within the cetacean order, including whales, dolphins, and porpoises."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
