A BILL FOR AN ACT

 

 

relating to reusables.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  (a)  There is established within the department of health, a three-year pilot program to be known as the upcycled mobile dishwashing system pilot program to create a circular reuse dishwashing system within the Kohala district.  The pilot program shall utilize an upcycled shipping container that can be placed on county or state property, using existing renewable energy and water infrastructure.

     (b)  The department of health shall establish the following two full-time equivalent positions (2.0 FTE):

     (1)  A committee-appointed consultant position that shall work with the department to manage and implement the upcycled mobile dishwashing system pilot program, including ensuring best practices are utilized for the oversight of the program; and

     (2)  A developer to design a reusable certification program, including a permitting process, and methods for collection, sanitization, and redistribution of preapproved containers according to standards adopted for the program.

     (c)  The department of health shall submit a report of its findings and recommendations, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the Regular Session of 2027.

     SECTION 2.  In accordance with section 9 of article VII of the Hawaii State Constitution and sections 37-91 and 37-93, Hawaii Revised Statutes, the legislature has determined that the appropriations contained in Act 164, Regular Session of 2023, and this Act will cause the state general fund expenditure ceiling for fiscal year 2024-2025 to be exceeded by $           or       per cent.  This current declaration takes into account general fund appropriations authorized for fiscal year 2024-2025 in Act 164, Regular Session of 2023, and this Act only.  The reasons for exceeding the general fund expenditure ceiling are that:

     (1)  The appropriation made in this Act is necessary to serve the public interest; and

     (2)  The appropriation made in this Act meets the needs addressed by this Act.

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $405,573 or so much thereof as may be necessary for fiscal year 2024-2025 to:

     (1)  Create and implement the upcycled mobile dishwashing system pilot program; and

     (2)  Establish one full-time equivalent (1.0 FTE) consultant position and one full-time equivalent (1.0 FTE) developer position within the department of health for the pilot program.

     The sum appropriated shall be expended by the department of health for the purposes of this Act.

     SECTION 4.  This Act shall take effect on July 1, 2024.
